CLARIFICATORY GUIDELINES IN THE PROVISION OF LINE HANDLING SERVICE AND THE COLLECTION OF GOVERNMENT SHARE THERETO



In consonance with Section 6 (iii and v) of PD 857 and PPA Memorandum Order Nos. 32 and 22, Series of 1998 and 1999, respectively, which cover the services of making fast and letting go lines of vessels alongside pier, wharf, etc. and to ensure strict observance and implementation of the prescribed service rates and the remittance of the government share thereto, the following clarificatory guidelines are hereby issued for information and compliance.
  1. As a general policy, the PPA authorized cargo handling contractor/operator shall be responsible for securing the lines of vessels berthing in their respective areas of operations and under no instances shall allow any other party or sub-contracted to a third party the provision of line handling.

  2. However, in the ports where the line handling is provided by another operator by virtue of the existing contract between the cargo handler and the sub-contractor. PPA shall allow the sub-contractor to render the lined handling service until the expiration of the contract.  Thereafter, the authorized cargo handler thereat automatically takes over the provision of said service in the port.

  3. The mooring/unmooring services are considered components of cargo handling services in the port. Pending rationalization of the existing tariff, the rates applicable shall be those prescribed in the cargo handling schedule of rates for the particular port as listed in Annex "A".  In the absence thereof, rates/charges shall be prescribed by CSD, PPA through the Port Manager.

  4. Income of the operator by making fast and letting go lines services shall form part of the overall income, subject to the remittance of the corresponding government share pursuant to the scheme stipulated in the Cargo Handling Contract/Permit

  5. In cases where the CHO enjoys the "FIXED FEE" privilege, the operator shall remit to the Authority the government share derived from line handling services.

  6. To ensure the safety of the portworkers, pedestrians and passengers during the conduct of the line handling activity, the authorized operator shall strictly follow the procedures and preventive measures stipulated in PPA Administrative Order No. 06-81

  7. The Terminal Supervisor shall ensure that the authorized line handling operator provide the service within the prescribed standards of the Authority and impose fees in accordance with the rate prescribed therefor.
This Order shall take effect immediately.
