[ BI MEMORANDUM ORDER NO. ADD-02-028, JUNE 25, 2002, June 25, 2002 ]
GUIDELINES FOR SOUTH KOREAN TOUR GUIDES
In an effort to address the genuine concerns raised by local tourism authorities, the hotel and resort industry and tour guide sector, the following guidelines shall regulate the activities of South Korean tour guides in the Philippines:
1. All South Korean tour guides shall be accredited by the Department of Tourism (DOT) and the Bureau of Immigration (BI) before engaging, for profit or non-profit, in any tourist-related or tourist-oriented activities in the Philippines;
2. An accredited South Korean tour guide shall, upon application, be allowed an extension of stay for a period of one year, Provided, that he/she is maintaining a lawful presence in the Philippines;
3. During the one year extended stay, the accredited South Korean tour guide may engage, either for profit or non-profit, in any tourist-related or tourist-oriented activity in the Philippines, Provided, that a special work permit is issued by the Commissioner of Immigration under Commonwealth Act (C.A.) No. 613, Section 42(a) (32) and Provided further, that proof of a Philippine understudy is submitted to the Commissioner of Immigration;
4. An accredited South Korean tour guide under this Memorandum Order may engage in any tourist-related or tourist-oriented activity beyond the one year extended stay, Provided, that he/she files for and obtains a pre-arranged employment visa under C.A. No. 613, Section 9(g), Provided, further, that he/she presents an alien employment permit issued by the Department of Labor and Employment, Provided moreover, that proof of a Philippine understudy is submitted to the Commissioner of Immigration and, Provided finally, that South Korean tour guides who are endorsed by the United Korean Community Association (UKCA), Inc., shall be governed by the BI-UKCA Memorandum of Understanding dated 5 February 2002;
5. For monitoring purposes, the UKCA undertakes to assist by regularly providing the DOT and the BI with a directory of all accredited South Korean tour guides subject to this Memorandum Order; and
6. This Memorandum Order shall be subject to review, amendment and/or revocation one (1) year from the date of actual implementation.
This Memorandum Order shall take effect immediately.
