[ POEA MEMORANDUM CIRCULAR NO. 09, s .1998, May 08, 1998 ]

PLACEMENT FEE CEILING FOR TAIWAN AND KOREAN MARKETS



Pursuant to Governing Board Resolution No. 2, series of 1998, a uniform placement fee ceiling of one month salary exclusive of documentation and processing costs, as fixed under Department Order No. 34, series of 1996, shall be adopted for all landbased workers including those hired for the Taiwan and Korean markets.

In view thereof, Memorandum Circular No. 5, series of 1997, implementing said Department Order No. 34, series of 1996 is hereby amended to cover the Special Markets of Taiwan and Korea.

This Memorandum Circular takes effect immediately.

Governing Board Resolution No. 02 s. of 1998

WHEREAS, Department Order No. 34, s. 1996 fixed the allowable placement fee that a Iandbased agency may demand and collect from its hired workers at a ceiling equivalent to one month salary exclusive of documentation and processing costs.

WHEREAS, the above mentioned Department Order does not cover the markets of Taiwan and Korea, where the prevailing fees are: one month salary as mobilization fee plus P 5,000.00 placement fee for Taiwan and P 10,000.00 mobilization fee plus engagement fee of P 5,000.00 for Korea under the Korean Federation of Small Business Scheme.

WHEREAS, there is a need to adopt a placement fee that shall be applicable to all overseas Filipino Iandbased workers which is responsive to the rapidly changing market conditions and the rising cost of deployment and placement of workers;

NOW. THEREFORE, the POEA Governing Board, in a meeting duly convened, hereby resolves to adopt a uniform placement fee ceiling of one month salary exclusive of documentation and processing costs for all Iandbased workers including those hired for the Taiwan and Korean markets.

Agencies and employers who are presently non-fee charging are encouraged to continue said practice.
