[ PAB RESOLUTION NO. 03, S. 2004, July 06, 2004 ]

REQUIRING THE SUBMISSION OF SELF MONITORING REPORT (SMR) OF FIRMS WITH PENDING PAB CASES



WHEREAS, the enactment of Department Administrative Order (DAO) No. 2003-27 amended certain provisions of DAO 26, that includes the format required for the Pollution Control Officer's (PCO) report provided for in Annex C thereof;

WHEREAS, the previously termed PCO reports is now named SMR with the incorporation of the necessary amendment/repeal provided in the Procedural and Reference Manual for DAO 2003-27, which was prepared by the EMB and became effective on August 2003;

WHEREAS, the format prescribed in Annex C of DAO 26 was expressly required by the Board in its Resolution No. 02, Series of 2001;

WHEREAS, the PAB upon review of the amended formats, noted the same to be more comprehensive to conform with the evidentiary requirements of the Board in the litigation of pending pollution cases;

WHEREAS, based on the foregoing developments, PAB sees the need to adopt the amended format, thereby recognizing the need to repeal PAB Resolution No. 02, Series of 2001.

WHEREAS, the Board observed that the abovementioned DAO No. 2003-27 will not impair nor restrain the PAB from requiring the monthly submission of the said SMRs.

RESOLVED, AS IT HEREBY RESOLVED, that the PAB hereby repeal PAB Resolution No. 02. Series of 2001, and require all Pollution Control Officer of firms with pending PAB cases to submit to the Board monthly Self-Monitoring Reports in accordance with Procedural and Reference Manual for DAO-2003-27.

The firms herein concerned shall comply with the submission of report in the following manner:

  1. One time submission of general information sheet (Module 0);
  2. Should there be any changes/revisions that will affect the General information sheet (Module 0), the concerned firm shall submit a General Information (Module 1);
  3. Monthly submission of SMR (Module 3) for firms with pending case for violation of P.D. 984 (water pollution);
  4. Monthly submission of SMR (Module 4) for firms with pending case for violation of R.A. 8749 (air pollution);
  5. Submission of other undertakings/events provided for in Module 6 of the Procedural Reference Manual as the need arises.

RESOLVED FURTHER, That all submitted SMRs shall be under oath, signed by the firms managing head and its PCO, and duly received by the Regional Office.  Furthermore, ALL Regional Offices shall furnish the Board semi-annually, list of all the companies who have complied with the submission of said SMRs.
