SECURITY REQUIREMENTS FOR AIRLINES, GENERAL AVIATION AND AIRPORT SERVICE PROVIDERS



Pursuant to Section 3.3.1 and 3.1.4 in the Amendment 10 of the International Civil Aviation Organization (ICAO) Annex 17, this is a regulation to define security standards for airlines, general aviation, and airport service providers and to delineate and allocate security tasks in the furtherance of the National Civil Aviation Security Program (NCASP).


RULE I


SECTION 1. Background – Civil aviation security is a concern of all airlines and other airport service providers. They are expected to contribute respective share to provide adequate protection to our airports. All security protocols and standards shall be performed/ complied with by airlines, general aviation, and airport service providers including the airport authority/management, caterers, ground handlers, AVSEC training centers, security providers and cargo forwarders with personnel deployed at the airside.

SECTION 2. Standard Requirements – The following are standard requirements for the airlines, general aviation, and airport service providers to comply with the National Civil Aviation Security Program (NCASP);

2.1
All airport service providers required by the programme shall develop, implement and make current their respective operators/facility security programs.
2.2
The same document shall be submitted to OTS annually for evaluation to determine compliance with the National Civil Aviation Security Program and pertinent Transport Security Regulation (TSR) issued for the year.
2.3
The Airport Security program shall be guided by the protocols and standards provided in the National Program; while the “Airline-Operators’ Program” shall be in compliance with both the airport and national program.
2.4
Submission of the security program shall not be later than the 15th of December of each year; Result of the assessment of the program should be made by OTS not later than 15th of February the following year.
2.5
The security program shall be accompanied by a diskette to facilitate specific recommendations by OTS.
2.6
For uniformity, Arial font style and height of twelve (12) shall be used in encoding the document and double spaced in 8 ½”’ x 11” bond paper.
2.7
It shall be classified CONFIDENTIAL and properly marked on top of the first page of each chapter.
2.8
Each page and copy shall be properly accounted for and receipted by concerned personnel
2.9
Non-compliance with the foregoing security program (Aircraft Operators Program) by the aircraft owner/ appropriate or designed officer, shall be a ground for cancellation of franchise or a pre-requisite for the issuance and/or renewal of franchise with the Civil Aeronautics Board (CAB).

RULE II


SECTION 3. Construction – These rules shall be liberally construed in order to promote its security objectives.

SECTION 4. Reservation – Nothing herein shall be construed as precluding OTS through the Administrator from enforcing these rules in conducting inspection, investigation, evaluation, assessment and audit of the activities enunciated herein, and in prescribing other requirements to meet the constantly evolving challenges in transport security administration.

SECTION 5. Separability – If any provision or section of these rules is declared null and void by competent authority, the other stays and are not affected and shall remain in full force and effect.

SECTION 6. Effectivity – This Transport Security Regulation shall take effect immediately after publication in a newspaper of general circulation.
