GUIDELINES ON IMPORTED MOTOR VEHICLES UNDER THE BALIKATAN AND OTHER JOINT RP-US MILITARY EXERCISES PROGRAM



Pursuant to Article IV item 2 of the Agreement between the Government of the Republic of the Philippines and the Government of the United States of America regarding the treatment of United States Armed Forces Visiting the Philippines and in relation to the LTO implementing rules and regulations of RA 8794, the following guidelines are hereby adopted for the guidance of all concerned.

SECTION 1. Scope/Venue. — All motor vehicles brought into the Philippines by the US Servicemen who are participants in the BALIKATAN 2002 shall be classified as DIPLOMATIC under other tax-exempt category. Said motor vehicles, which are already in the Philippines prior to the issuance of this Memorandum Circular, shall be issued OEV plates and the recording thereof shall only be effected at the LTO Zamboanga City District Office. However, the covered motor vehicles, which arrived in the Philippines pursuant to Balikatan or other Joint RP-US Military Exercises Program after the issuances of this circular shall only be recorded at LTO District Office nearest the Regional Office and the Port of Entry.

SECTION 2. Documentation. — For the initial recording of these motor vehicles, the following original documents shall be submitted:

a. Commercial invoice for new motor vehicles or Certificate Registration from country of origin for used motor vehicles.

b. Bill of Lading

c. BOC Certificate of Payment

d. BOC Informal Entry

e. Confirmation Certificate

f. Appropriate insurance coverage

g. LTO inspection (MVIR)

SECTION 3. Fees. — The authorized recording fee of Php 500.00 and other charges shall be imposed on the subject motor vehicles. The Certificate of Registration (CR) shall not be issued but only the MVRR/OR to acknowledge the receipt of payment.

SECTION 4. Renewal. — The renewal recording of these motor vehicles shall be at the same District Office where the initial recording was effected or at the District Office where the motor vehicle is physically located subject to the usual regulation of confirmation.

SECTION 5. Reporting. — The recording District Office through the Regional Office shall submit a monthly report to the Registration Section, Operations Division, Central Office as to the number of motor vehicles recorded under this program with the following column heading:

1. Name of owner

2. Complete address

3. Make and type of the motor vehicle

4. Year model

5. Engine number

6. Chassis number

7. Gross vehicle weight

8. OEV Plate number

SECTION 6. Transfer of Ownership. — Vehicles covered by the Agreement shall not be transferred to non-exempt persons unless the corresponding BOC duties and taxes due and collectible on the covered imported motor vehicles shall have been paid.

SECTION 7. Administrative Sanctions. — Any LTO official or employee violating the provisions of this Memorandum Circular shall be subject to disciplinary action.

SECTION 8. Repealing Clause. — All memoranda and circulars in conflict herewith are deemed superseded.

SECTION 9. Effectivity. — This memorandum circular shall take effect immediately.
