[ LTFRB MEMORANDUM CIRCULAR NO. 96-017, May 02, 1996 ]

IMPLEMENTATION OF EXECUTIVE ORDER NO. 202 FOR THE JURISDICTION OF LTFRB-NCR TO ACCEPT, HEAR AND DECIDE UNCONTESTED APPLICATIONS/PETITIONS FOR ROUTES WITHIN METRO MANILA



Executive Order No. 202 dated June 19, 1987 provides for the creation and jurisdiction of Regional Franchising and Regulatory Offices. The National Capital Region (NCR) which covers the Metro Manila area is one of the regions in the country established by law. Executive Order No. 202, Section 7 states;
"Creation of Regional Franchising and Regulatory Offices. There shall be a Regional Franchising and Regulatory Offices in each of the administrative regions of the country which shall be headed by a Board Regional Manager having the rank, salary and privileges of the Department Assistant Regional Director. The Re­gional Franchising and Regulatory Offices shall hear and decide uncontested applications/petitions for routes within their respective administrative regions: Provided: that applications petitions or routes extending beyond their respective territorial jurisdictions shall be heard and decided by the Board."
In view hereof, applications/petitions for authority to operate (CPC) all motorized land based transportation services within Metro Manila shall be filed with the National Capital Region (NCR), LTFRB. The NCR, LTFRB shall hear and decide uncontested application/petition for routes and operation of public land transportation within Metro Manila including thereof other petitions incidental thereto.

The NCR, LTFRB is hereby directed to coordinate with the Management Information Division regarding the transfer of records as a result of the herein Memorandum.

The Memorandum Circular shall take effect fifteen (15) days after the filing of three (3) copies hereof with the U.P. Law Center pursuant to Presidential Memorandum Circular No. 11 dated October 9, 1992.

Strict compliance herewith is hereby enjoined.
