[ PRC BOARD OF MEDICINE RESOLUTION NO. 26-98, May 25, 1998 ]

NEW GUIDELINES FOR THE IMPLEMENTATION OF THE ONE-YEAR REFRESHER COURSE FOR EXAMINEES WHO FAILED THREE TIMES IN PHYSICIAN LICENSURE EXAMINATIONS AS A REQUIREMENT FOR TAKING SUBSEQUENT PHYSICIAN LICENSURE EXAMINATIONS



WHEREAS, Section 21, Article III of Republic Act No. 2382, as amended, otherwise known as the “Medical Act of 1959” provides, among others, that “a candidate who fails for the third time in the complete or final examinations will be required to take a refresher course prescribed by the Board of Medicine of at least one (1) year in a recognized medical school or college before he could be allowed to take subsequent examinations.”

WHEREAS, the Board of Medicine issued Board Resolution No. 153, Series of 1990 providing for a refresher course for examinees who failed three (3) times in physician licensure examinations in accordance with the above-quoted provisions of Section 21 of the Medical Act of 1959, as amended, but the refresher course was administered by an institution which is not a recognized school or college of medicine.

WHEREAS, the Board of Medicine after consultations with the deans of the various schools and colleges of medicine, deems it necessary to adopt new guidelines for the implementation of the one-year refresher course for examinees who failed three times in physician licensure examinations.

WHEREFORE, the Board RESOLVED, as it hereby RESOLVES, to require examinees who failed three (3) times in physician licensure examinations to take a refresher course of at least one year in a recognized school or college of medicine before they could be allowed to take subsequent physician licensure examinations in accordance with the following guidelines:

1. Examinees who failed three (3) times in physician licensure examinations and who obtained failing grade or grades in any subject or subjects in three complete or final examinations shall be required to enroll in the subject or subjects in which they failed in the said examinations in a recognized medical school or college.

2. Examinees who failed three (3) times in physician licensure examinations but who obtained passing grades three times in any subject or subjects in three complete or final examinations shall not be required to enroll in the said subject or subjects.

3. The deans of recognized schools or colleges of medicine shall accommodate for enrollment examinees who fall under No. 1 above to take a refresher course for at least one year in the said schools or colleges of medicine as provided in Section 21 of the Medical Act of 1959, as amended.

For purposes of enrollment in a recognized medical school or college, the examinee who failed three (3) times in physician licensure examinations and required to take the refresher course provided herein, shall submit his/her reports of ratings in the three (3) licensure examinations he or she has taken for the guidance of the registrar in determining the subjects said three-time flunker has to be enrolled in accordance with No. 1 above.

4. The registrars of recognized schools or colleges of medicine where there are refresher-enrollees shall submit to the deans of said schools or colleges of medicine a list of enrollees taking a refresher course indicating therein the subjects they are enrolled.

The refresher-enrollee shall be exempted from laboratory work/study in the basic subject if such work or study is a component of the subject they are enrolled in.

5. The deans of recognized schools or colleges of medicine where examinees who failed three times in physician licensure examinations are enrolled shall, after the refresher-enrollees have completed the one-year refresher course, issue a certification that, on the basis of the performance and reports of attendance submitted by professor/s of the subjects where said refresher/enrollees are enrolled, the refresher-enrollees have satisfactorily completed the one-year refresher course. The dean’s certification, with the seal of his office affixed, shall be the basis of the Board in allowing a three-time flunker to take the physician licensure examination.

The dean shall not include in the certification the name of a refresher-enrollee if it is shown by the professor’s report of attendance that the refresher-enrollee has incurred absences in the aggregate of 20% or more of the required total number of hours of attendance of students in the subject or subjects where the three-time flunker is enrolled.

Let copies of this Resolution be given to all schools, colleges and universities offering course in medicine for compliance and for dissemination to their graduates.

Board Resolution No. 153, Series of 1990 is hereby repealed. All other resolutions and rules and regulations which are inconsistent with this Resolution are hereby repealed or modified accordingly.

This Resolution shall, after approval hereof by the Commission, take effect after fifteen (15) days following its publication in the Official Gazette or in a newspaper of general circulation, whichever is earlier.
