[ CSC MEMORANDUM CIRCULAR NO. 41, August 22, 1990 ]
TRANSFER OF EMPLOYEES TO AGENCIES WHICH THEY EXERCISE OVERSIGHT FUNCTION
Pursuant to its En Banc Resolution No. 90-782 dated August 22, 1990,
the Civil Service Commission hereby adopts and promulgates the following
policies governing transfer or appointment of an officer or employee to
agency over which he exercises oversight functions.
1. Heads of unit/field office/provincial office and his staff are prohibited from transferring or being appointed to any position in the department/ agency/office/local government unit which his unit is assigned or designated to oversee within one (1) year after the termination of such assignment/designation.
2. Any request for transfer or resignation which purpose is to effect transfer of such nature shall not be acted upon by the authority concerned within the same period, unless it is clearly shown that said transfer is in the exigency and in the best interest of the service.
