[ DENR ADMINISTRATIVE ORDER NO. 2004-02, February 16, 2004 ]

IMPLEMENTING RULES AND REGULATIONS (IRR) OF REPUBLIC ACT NO. 9120 FOR THE DISPOSITION OF CERTAIN PORTION OF ALIENABLE OR DISPOSABLE LAND SITUATED AT RAMESAMEU/COWRIE ISLAND, PUERTO PRINCESA CITY, PALAWAN



Pursuant to Executive Order No. 192 and in consonance with the mandatory provision of Section 2, Republic Act 9120 promulgated on April 20, 2001, the following rules and regulations in disposition of certain portion of alienable and disposable land comprising the island known as "Rameysamey/Cowrie Island" situated at Puerto Princesa City, Palawan are hereby prescribed for the guidance and compliance of all concerned.

1.  All public land applications shall be filed with the CENR Office of Puerto Princesa City, where the said parcels of land are located;

2.  The Community Environment and Natural Resources Office (CENRO) of Puerto Princesa City within whose jurisdiction the land being applied for is located shall conduct the necessary Administrative Order No. 24-1998 dated June 1998 and other related rules and regulations;

In addition to existing information/requirements, investigation report shall ascertain among others the conduct of the following:

a.  Delimitation of the area to determine the disposable portion;
b.  Perimeter or external boundary survey of the whole area;
c.  Projection of the area in a map marking in dotted lines the foreshore area to be excluded;

3.  The area shall be disposed of and processed through the regular procedures in accordance with the provisions of the Public Land Act (Commonwealth Act 141), RA 9120 dated April 20, 2001 and such other related land laws in the disposition of alienable and disposable lands of the public domain; and

4.  Processing of all applications shall be made in close coordination with the Office of the Palawan Council for Sustainable Development (PCSD);

All orders, circulars and other issuances inconsistent herewith are hereby revoked or modified accordingly.

This Order shall take effect fifteen (15) days after its publication in a newspaper of general circulation copy furnished the Office of the U.P. Law Center.
