[ SRA CIRCULAR LETTER NO. 45, August 28, 1996 ]

SRA SANCTIONS IMPOSED ON IMPORTERS/CONSIGNEES OR PARTIES RE: ILLEGAL WITHDRAWAL OF IMPORTED 'C' OR RESERVE SUGAR



Pursuant to Sugar Order No. 8, Series of 1994-1995, dated 17 May 1995, and Circular Letter No. 20, Series of 1995-1996, dated 22 February 1996, turning over to the Sugar Regulatory Administration {SRA) for constructive custody all imported sugar classified as ‘C’ or Reserve Sugar and prescribing the guidelines on the withdrawal of said imported 'C sugar respectively, it is hereby ordered to all concerned that the following sanctions shall be imposed on imported/consignees or parties found to have violated the abovementioned SRA Sugar Order and Circular Letter, specifically the illegal withdrawal of the said imported 'C sugar, to wit:

1. All domestically produced raw sugar as mill share, of all sugar mills found to have advanced refined or withdrawn without prior authority from the SRA the imported raw 'C’ sugar, whether as importers/consignees or depositories of said imported sugar, shall be classified as 'C' or Reserve Sugar, the volume of which shall equal the shortages reported by the physical   stock inventory conducted by R.J. Del Pan & Co., Inc. per Circular Letter No. 31, Series of 1995-1996, dated 04 June 1996.

2. All Licenses To Operate issued by the SRA to all sugar traders who are importers/consignees of imported 'C' sugar are found to have withdrawn the said imported 'C' sugar without prior authority from the SRA, shall be cancelled or revoked or shall not be renewed in accordance with the undertakings executed by said SRA accredited sugar traders.

This Circular Letter shall take effect immediately.
