FURTHER AMENDING MMA ORDINANCE NO. 1, SERIES OF 1993 AS AMENDED, ENTITLED "MMA FINANCIAL ASSISTANCE TO GOVERNMENT TRAFFIC ENFORCEMENT UNITS IN METRO MANILA"



WHEREAS, Section 1 of Ordinance No. 1, Series of 1993 as amended, entitled "MMA Financial Assistance to Government Traffic Enforcement Units in Metro Manila" provides that out of the fifteen percent (15%) intended as financial assistance to Traffic Enforcers and Traffic Enforcement Units, ten percent (10%) shall be given to Traffic Enforcers concerned to be disbursed through Automated Teller Machine (ATM); WHEREAS, as an incentive to the Traffic Enforcers, the Metro Manila Council deems it necessary to increase said financial assistance from ten percent (10%) to twenty percent (20%);

WHEREAS, there is also an urgent need to provide financial assistance to the Offices of Traffic Commanders and Directors in order to effectively carry out their traffic management and operations functions.

NOW THEREFORE, be it resolved as it is hereby resolved, that the Council hereby further amends MMA Ordinance No. 1, Series of 1993 as amended by MMDA Regulation No. 98-002 of which Sections 1 and 4 thereof shall now read as follows:

SECTION 1.   Manner of Disbursement and Distribution — The total amount of traffic fines collected shall be distributed to the following as incentive:

a.         Twenty percent (20%) shall be given to Traffic Enforcers concerned to be distributed through Automated Teller Machine (ATM);

b.         Five percent (5%) shall be given to Traffic Enforcement Units;

c.         Fifteen percent (15%) shall be released to the Traffic Commanders of various levels (Group Director, District Director/DTOs/Unit Heads, City/Municipal Traffic Chiefs and Sector heads);

d.         Ten percent (10%) shall be given to the Local Government Units (LGUs) concerned where the violation is committed to be utilized for the maintenance and operation of traffic management in their respective jurisdiction.

e.         Fifty percent (50%) shall be used by the Authority to implement such programs, projects and activities as may be approved by the Metro Manila Council pursuant to Section 10 of RA 7924.

RESOLVED FINALLY, that the Traffic Operations Center shall formulate the necessary implementing guidelines for the implementation of this Regulation.

This Regulation shall take effect upon approval.
