ADOPTING DEPARTMENT OF TRANSPORTATION AND COMMUNICATIONS DEPARTMENT ORDER NO. 93-693 SERIES OF 1992 PROHIBITING THE USE OF TINTED, COLORED OR PAINTED WINDSHIELDS OR WINDOW GLASS, CURTAINS, BLINDS AND OTHER SIMILAR DEVICES ON PUBLIC MOTOR VEHICLES



WHEREAS, Department of Transportation and Communications (DOTC) Department Order No. 93-693 series of 1992 prohibits the use of curtains, tinted glass, blinds and other similar devices on public motor vehicles;

WHEREAS, in spite of the said order, the use of curtains, dark tinted glass, blinds and other similar devices on public utility vehicles is very rampant thus encouraging robbers/criminals to do illegal activities inside said vehicles;

WHEREAS, in order to ensure the safety of the riding public and to prevent robbery/hold-up inside public utility vehicles, the Metro Manila Council (Council) deems it necessary to reinforce existing law that prohibits the use of curtains, tinted glass, blinds and other similar devices on public utility vehicles.

NOW, THEREFORE, be it ordained by the Council, pursuant to Section 5 (f) of RA 7924 that:

Section 1. DOTC Department Order No. 93-693, s. 1992 is hereby adopted for strict implementation throughout Metro Manila.

Section 2. Coverage. Public utility buses, jeepneys, FXs, taxis and school buses operating within Metro Manila are prohibited from using dark tinted, colored or painted windshield or window glass, curtains, blinds and other similar devices on motor vehicles that obstruct the view from the outside.

Section 3. Penalty. The owner/operator of a motor vehicle shall be penalized by a fine of FIVE HUNDRED PESOS (P500.00) if his vehicle is found to have curtains, blinds and other similar devices on the windshield or window glass thereof is darkly tinted, colored or painted.

In addition thereto, outright removal of curtains, blinds and other similar devices will be done for vehicles using said devices.  In the case of darkly tinted, colored or painted windshields or window glass, the MMDA Traffic Operations Center shall have the authority to remove the tint/paint at the expense of the owner/operator of the motor vehicle for the cost incurred therefor.

Section 4. Effectivity. This Regulation shall take effect fifteen (15) days after its publication in two (2) newspapers of general circulation in Metro Manila.
