[ PPA ADMINISTRATIVE ORDER NO. 02-99, March 05, 1999 ]
AMENDING PROVISION NO. 10 OF PPA ADMINISTRATIVE ORDER NO. 05-95 AND RELATED MATTERS
In view of the modernization thrust on government ports pursuant to Presidential Executive Order No. 59 and to rationalize the implementation of the guidelines on RORO operation after cargo handling contract termination, the following guidelines amending Provision No. 10 of PPA Administrative Order No. 05-95 are hereby issued:

Scope
This Administrative Order shall cover all domestic loaded/discharged to/from RORO vessels that call at all government ports and are operated by cargo handlers with expired cargo handling contracts/permits and are holders of duly issued HOA or HOPs.

Specific Guidelines
2.1 RORO operations shall continue to be handled by the incumbent cargo handler concerned.
2.2. The incumbent cargo handler shall apply the prescribed handling fees provided in Sec. 8 of PPA AO No. 05-95, as amended by AO No. 07-98.
2.3 The income derived by the cargo handler from RORO operation shall form part of their gross income and the government share of the Authority shall be based on the pertinent provisions of their HOA or HOP.

Repealing Clause
All PPA issuance, or parts thereof, which are inconsistent herewith are hereby repealed or amended.

Effectivity
This Order shall take effect immediately and shall remain in force until revoked or amended.
