[ PPA MEMORANDUM ORDER NO. 14-96, October 01, 1996 ]

ISSUANCE AND EXTENSION OF HOLD OVER AUTHORITIES FOR EXPIRED PERMITS TO OPERATE CARGO HANDLING SERVICES



As an interim measure and pending the implementation of the Revised Delegation of Authority and to provide expedient action on the issuance of hold over authorities (HOA) for expired permits to operate cargo handling (CH) services, the following guidelines are hereby prescribed:

1.         Appropriate hold over authority for expired permits to operate (PTOs) shall be issued by the Port Managers, for periods of 3 months duration including extensions thereof whenever necessary and warranted for ports with less than 20,000 metric tons (MT) annual throughout and by the Port District Manager for ports with 20,000 MT or more.

2.         Only CH operators with pending renewal applications for evaluation and documentation shall be issued HOAs.

3.         All HOAs issued therefore shall contain, among others, and when applicable, the following specific conditions:
3.1     The CH operator shall comply with the terms and conditions of the expired PTO, including applicable provisions of PPA AO 10-81 and relevant PPA policies, rules and regulations.

3.2     Specific audit findings and recommendations requiring immediate rectification and compliance to ensure efficient provision of the CH service are substantially complied with, including the payment of assessed unpaid obligations of the CH operator to the Authority.

3.3     The HOA can be terminated for cause at any time or upon the issuance of a regular PTO.
4.         The 3-month duration/validity of the HOA or its extension shall specifically provide the dates of effectivity and expiration.

5.         A copy of all issued HOAs or extension thereof must be furnished the PDO concerned and the Office of the AGM for Operations for information/reference.
