[ PPA MEMORANDUM CIRCULAR NO. 07-97, March 04, 1997 ]

STANDARDIZED ANCILLARY SERVICES PERMIT AND REGULATORY FEES AND CLARIFICATION OF SECTIONS 8.1 & 8.2 OF PPA AO NO. 08-96




1. AUTHORITY

1.1       Sections 20(a), Article VII of PD 857, Revised Charter of PPA

1.2       Sections 8.1 and 8.2 of PPA Administrative Order No. 08-96 dated April 19, 1996, re Regulations for the Registration and/or Grant of Permits for the Operation of Ancillary Services in the Ports.

2. OBJECTIVES

2.1       To standardize the rates/charges in the issuance of licenses for ancillary services.

2.2       To promote efficient and effective ancillary services operation in all government ports.

2.3       To encourage more private sector participation in the provision of ancillary services.

3. PROVISION

In order to have uniform charges in the issuance of ancillary services permit, the following rates are hereby prescribed:

Permit Fee         P300 per annum (for Port
Ancillary Services I and II under PPA AO No. 08-96)

Regulatory Fee  P1,500 per annum (For Port
Ancillary Services II under PPA AO No. 08-96)

Ancillary service operators using PPA-owned facilities (water supply facilities, weighbridge/truck scale, etc.) in the port, shall remit to the Authority not less than 10% of their gross income derived from the operation of ancillary services in addition to the permit fee of P300 per annum plus the value added tax due thereon. However, operators who bring in ships supply such as fresh water using their own trucks and hoses are subject to a regulatory fee only at P1,500 per annum, plus VAT.

4. REPEALING CLAUSE

All PPA orders, circulars and other issuances inconsistent herewith are hereby repealed or amended accordingly.

5. EFFECTIVITY

This Circular shall take effect fifteen days after publication in a newspaper of general circulation.
