[ PRC RESOLUTION NO. 07-390, S. OF 2007, March 15, 2007 ]

AMENDMENT TO SECTION II(1) OF RESOLUTIONS NOS. 02-47 AND 02-30 OF THE BOARD OF MARINE DECK OFFICERS AND THE BOARD OF MARINE ENGINEER OFFICERS, RESPECTIVELY, RE: POLICY AND GUIDELINES IN THE IMPOSITION OF PENALTY FOR SUBMITTING FAKE/FRAUDULENT DOCUMENT/S



WHEREAS, after more than five (5) years of implementation, the Commission deems it necessary to have a review of Resolutions Nos. 02-47 and 02-30 of the Boards of Marine Deck and Engineer Officers, respectively, as regards the imposition of one (1) year suspension from the practice of the maritime profession upon erring marine officers who submitted fake/fraudulent documents;

WHEREAS, the Commission perceived that the Imposition of one (1) year suspension from the practice of the maritime profession by marine officers found guilty of submitting fake/fraudulent document/s for the first time is severe a penalty which must be tempered for humanitarian considerations:

WHEREFORE, the Commission RESOLVES to amend Section II(1) of Resolutions Nos. 02-47 and 02-30 of the Boards of Marine Deck and Engineer Officers, respectively, which shall now read as follows:

“II. FOR MARINE DECK AND MARINE ENGINEER OFFICERS

1. First Offense
-
Six (6) months suspension
2. Second Offense
-
Two (2) years suspension
3. Third Offense
-
Revocation of License/Certificate”

RESOLVED FURTHER, that this Resolution shall likewise apply to marine deck and engineer officers who are presently serving their penalty of suspension.

This Resolution supersedes any previous issuance to the contrary and shall take effect immediately.

Let copies of this Resolution be furnished the U.P. Law Center and published in the Official Gazette or in a newspaper of nationwide circulation.
