[ SRA SUGAR ORDER NO. 4, S. OF 2007-2008, October 17, 2007 ]

REINSTATEMENT OF EXPIRED (HOMELESS) “D” QUEDANS OF CROP YEAR 2006-2007



WHEREAS, Section 2  (B) of Executive Order No. 18, Series of 1986 mandates the Sugar Regulatory Administration (SRA) to establish and maintain such balanced relation between production and the requirements for sugar and to maintain such marketing conditions as will ensure stabilized prices at levels reasonably profitable to the producers and fair to consumers;

WHEREAS, the SRA is mandated by Executive Order No. 18, Series of 1986, to protect the interest of the sugar industry in general and sugar producers in particular, without compromising our export commitment to the U.S.;

WHEREAS, Circular Letter No. 1, Series of 2007-2008 has declared “expired and non-negotiable (homeless)” the “D” quedans which have not met the August 31, 2007 deadline as stated in Sugar Order No. 10, Series of 2006-2007;

WHEREAS, Sugar Order No. 1, Series of 2007-2008 has made the “D” or World Market sugar available for use of the sugar-based food processors/exporters subject to requirements set by SRA:

NOW, THEREFORE, under and by virtue of the authority vested in the Sugar Regulatory Administration (SRA), it is hereby ordered that:

SECTION 1. Reinstatement of Homeless “D” Quedans of Crop Year 2006-2007. The “D” sugar quedans which were declared as “D” homeless sugar pursuant to Circular Letter No. 1, Series of 2007-2008 dated 04 September 2007 in relation to Sugar Order No. 10, Series of 2006-2007 are hereby qualified for reinstatement as “D” or World Market Sugar;

1.1 The “D quedans covering the “D” homeless” sugar shall be subject to verification prior to reinstatement as “D” or World Market sugar;

1.2 The application for verification of the subject “D” quedans shall be filed with the SRA Quezon City, attached thereto the “D” quedans and a corresponding list by mill/by quedan number;

1.3 A reinstatement fee of TEN PESOS PER LKG-BAG (Php10/Lkg-bag) shall be paid upon filing of the application for verification with the SRA;

1.4 All “D” quedans subject for verification shall be stamped at the back thereof as Re- instated “D” homeless sugar into “D” or World Market sugar per S.O. No. 4, Series of 2007-2008;

1.5 All fees and charges due the SRA for the processing of documents relative to the exporting of the “D” sugar shall be subject to SRA General Administrative Order No. 1, Series of 2002-2003 dated 20 February 2003;

1.6 All forms and/or documents relevant to export of sugar to the World market sugar as prescribed in Circular Letter No. 44, Series of 1995-1996, shall remain in force.

SECTION 2. Effectivity. This Sugar Order shall take effect immediately.

SECTION 3.  Consistency. Provisions of Sugar Orders, Circular Letters, and/or other Rules and regulations contrary to or inconsistent with this Sugar Order, are hereby amended, modified or revoked accordingly.
