REFUND OF DEATH GRATUITY



1.      Pursuant to Section 14, RA 6948, the next of kin of military personnel who has already been paid a death gratuity under RA 573 or RA 610 may apply for death pension on condition that the death gratuity received shall be refunded from such future payments of death pension in a reasonable monthly amount as may be determined by PVAO until the death gratuity is fully refunded.

2.      The following rules shall apply in the implementation of the cited provision:

2.1
A pensioner shall be required to refund only the portion of the death gratuity actually paid to the pensioner in accordance with the decree of distribution.

2.2
A monthly refund shall be deducted regularly from the monthly death pension of the pensioner starting April 1990 and until the refundable amount is fully paid.

2.3
The amount of monthly refund shall be FORTY PERCENT (40%) of the monthly death pension as follows:

3.      A notice of refund assessment will be sent to each pensioner upon approval of the pensioner’s application for death pension.
