(NAR) VOL. IV NO. 1 / JANUARY - APRIL 1993

[ HLRB RESOLUTION NO. R-515 1992, August 17, 1992 ]

REQUIRING A FIVE METER EASEMENT ON BOTH SIDES OF THE MARIKINA VALLEY FAULT TRACE AND SUCH OTHER FAULT TRACES ON THE GROUND IDENTIFIED BY PHILVOLCS, AMENDING CERTAIN PROVISIONS OF THE RULES AND REGULATIONS IMPLEMENTING PRESIDENTIAL DECREE NO. 957



WHEREAS, the Philippine Institute of Volcanology and Seismology (PHIVOLCS) recommended to include among the HLRB requirements for the processing of applications for and issuance of development permits and other clearances for land development projects within areas affected by the fault traces of the Marikina Valley Fault System (MVFS) and such other fault traces on the ground identified by PHILVOLCS, the provision for a five-meter buffer zone on both sides of the fault trace:

WHEREAS, the Board recognizes the possible implications of the MVFS and such other identified fault systems to land development projects within the affected areas:

WHEREFORE, be it RESOLVED as it is hereby RESOLVED by the Board in session duly assembled, to amend portions of Rules I and V of the Rules Implementing Presidential Decree No. 957 in the following manner:

1.      Rule I, Section 1, 11A-1 shall read as follows:

SECTION 1.       Application for Approval of Subdivision Plan. — Every registered owner or developer of a parcel of land who wishes to convert the same into a subdivision project shall apply with the Board (Commission) for the approval of the subdivision plan by filing in quadruplicate the following:

II.       For Complex Subdivision Projects:

A.      Approval of Preliminary Development Plan

1.  Site Development Plan signed by a licensed architect planner or engineer planner at a scale ranging from one is to one thousand (1:1,000) to one is to five thousand (1:5,000) showing the proposed layout of streets, lots, and other features in relation to existing conditions.  FOR PROJECTS LOCATED WITHIN AREAS TRAVERSED BY THE MARIKINA VALLEY FAULT TRACES AS MAY BE IDENTIFIED BY THE PHILIPPINE INSTITUTE OF VOLCANOLOGY AND SEISMOLOGY, THE OWNER/DEVELOPER THEREOF SHALL COORDINATE WITH PHILVOLCS FOR THE EXACT DELINEATION OF THE FAULT TRACES ON THE PLAN.

2.  The following provision shall be added to Rule I, Section IIB-3 and inserted as letter “e” thereof, adjusting the other provisions accordingly as letters “f”, “g” and “h”:

B.      Approval of Final Subdivision Plan

3.      Topographic Plan to include existing conditions as follows:

(e)        MARIKINA VALLEY FAULT TRACE AND SUCH OTHER FAULT TRACES IDENTIFIED BY PHIVOLCS ON THE GROUND SHOWING THE FIVE-METER MANDATORY EASEMENT ON BOTH SIDES OF THEIR FAULT TRACE MEASURED FROM THE EDGE OF SUCH FAULT TRACE.”
3.      The following provision shall be added to Rule V, Section 11 A-2 as second paragraph thereof:

2.      Design and Planning Consideration

FOR ALL TYPES OF SUBDIVISION PROJECTS, NO DEVELOPMENT SHALL BE ALLOWED WITHIN THE FIVE-METER MANDATORY EASEMENT ON BOTH SIDES OF THE MARIKINA VALLEY FAULT TRACE AND SUCH OTHER FAULT TRACES AS MAY BE IDENTIFIED BY PHILVOLCS.

4.      The following provision shall be added to Rule V, Section 12 C as number “5” thereof:

SECTION 12.    Design Standards and Guidelines for Residential Condominium Projects.

C.      Area Planning

5.      NO DEVELOPMENT SHALL BE ALLOWED WITHIN THE FIVE METER MANDATORY EASEMENT ON BOTH SIDES OF THE MARIKINA VALLEY FAULT TRACE AND SUCH OTHER FAULT TRACES AS MAY BE IDENTIFIED BY PHILVOLCS.”
