RESOLUTION NO. R-748, SERIES OF 2003, FURTHER RELAXING THE REQUIREMENTS FOR THE ISSUANCE OF CERTIFICATE OF REGISTRATION AND LICENSE TO SELL



Quoted hereunder is the above subject Resolution No. 748, which was approved by the Board on 17 September 2003:

WHEREAS, government recognizes housing as a strategic pump priming industry of the economy;

WHEREAS, the present housing production contributed by both the government and the private sector has been falling short of housing targets; this deficit is attributed to a number of factors, one of which is stringent and duplicitous government regulations and requirement; such as the requirement of DAR Conversion;

WHEREAS, EO 45 Series of 2001, calls for simplification of requirements and simultaneous and parallel processing of housing related permits and licenses of various agencies;

WHEREAS, RA 6657, which is the mandate of the DAR, provides in its scope of coverage and definition of terms that the law is applicable only to agricultural land not otherwise classified for residential, commercial, industrial or other similar development purposes;

WHEREAS, this Board has consistently held on the position that lands already classified as residential, commercial, industrial and other similar development purposes in Comprehensive Land Use Plans and Zoning Ordinances approved by the Board or Sangguniang Panlalawigan pursuant to EO 72, Series of 1993 are no longer agricultural in character;

WHEREAS, the issuance of Certificate of Registration and License to Sell by this Board does not exempt grantees thereof from compliance with and is without prejudice to the provisions of other existing laws;

WHEREFORE, be it resolved, as it is hereby resolved, that this Board shall no longer require as a precondition for issuance of Certificate of Registration and License to Sell a DAR Conversion Order in cases where the property involved is located in an area already classified as residential, commercial, industrial, or other similar development purposes as provided in CLUPs approved pursuant to EO 72, Series of 1993.

The above was published in the Philippine Daily Inquirer on 19 October 2003, and in accordance with the provisions of law, shall take effect fifteen (15) days from its date of publication.
