RESOLUTION NO. R-747, SERIES OF 2003, AMENDING SECTION 2.11 OF RULE 1 OF THE RULES AND REGULATIONS FOR MEMORIAL PARKS/CEMETERIES BY DELETING OPERATIONAL CLEARANCE ISSUED BY THE DEPARTMENT OF HEALTH (DOH) AS ONE OF THE REQUIREMENTS FOR FINAL PLAN APPROVAL OF MEMORIAL PARKS/CEMETERIES



Quoted hereunder is the above subject Resolution No. 747, which was approved by the Board 20 August 2003:

WHEREAS, the Rules and Regulations for Memorial Park/Cemetery was approved per HLURB Board Resolution No. 631, Series of 2000, dated 21 September 2000;

WHEREAS, Section 2.11 of Rule 1 of the same Rules and Regulations requires submission of BOTH INITIAL AND OPERATIONAL CLEARANCES from DOH as part of the documentary requirements for the approval of final memorial/cemetery plan;

WHEREAS, Section 3 of the Implementing Rules and Regulations of Chapter XXI - "Disposal of Dead Persons" of the Sanitation Code of the Philippines (P.D. 856), provides that the operational clearance shall be issued by the Regional Health Director upon completion of the cemetery or memorial park of private burial ground and before its operation;

WHEREAS, there is a need to harmonize the Board's policies with the policies of other government agencies concerned in the issuance of permits and clearances for memorial parks/cemeteries;

WHEREFORE, BE IT RESOLVED AS THE SAME IS HEREBY RESOLVED, that the OPERATIONAL CLEARANCE from DOH be deleted as one of the requirements for final plan approval of memorial park/cemetery project, thereby amending Section 2.11 of Rule 1 of the IRR for the Memorial Park/Cemetery, to read as follows:

The above was published in the Philippine Daily Inquirer on 30 September 2003, and in accordance with the provisions of law, shall take effect fifteen (15) days from its date of publication.
