AMENDMENT TO MEMORANDUM 89M-SEC-319 (OPERATIONAL AND ADMINISTRATIVE GUIDELINES ON THE DOTC-CORDILLERA ADMINISTRATIVE REGION)



Pursuant to Administrative Order No. 36 dated 23 September 1987 (Providing for the Establishment of Regional Offices in the Cordillera Administrative Region) and in accordance with the powers vested in me by virtue of Sec. 3, Chapter 1, Title XV Book IV of E.O. 292, for the purposes of fostering efficiency and development of DOTC-CAR, certain provisions of Memorandum No. 89M-SEC-319 dated 11 September 1989 are hereby accordingly amended as follows:

Organizational Linkages

The entire provision of Article I paragraph 1.1 is hereby amended to read as follows:

“1.1 The Regional Director of DOTC-CAR shall be under the direct supervision and control of the Department Secretary.”

Administrative Matters

Article 2, paragraph 2.1 of the Memorandum is likewise amended to read as follows:

“2.1 Delegation of Authorities and Delineation of Functions to the DOTC-CAR shall be in accordance with Department Order No. 99-1201 dated 19 January 1999”

“2.2 All functions pertaining to the Philippine Postal Corporation is hereby removed under the jurisdiction of the Regional Director of DOTC-CAR.”

Operating Matters

Lastly, Article 4, Section 4.1 paragraphs 4.1.3 and 4.1.6 are hereby amended to read as follows:

“4.1 DOTC-CAR, through its Regional Director, shall exercise all powers and functions enumerated under Sections 26 and 27 of Chapter 5, Book IV of E.O. 292 to the extent covering all the functional areas pertaining to TELOF, LTO, LTFRB, ATO within the Region. In addition thereto, the Regional Director shall perform all other functions as henceforth may be assigned by the Department Secretary.”

4.1.3 DOTC-CAR shall hear and decide uncontested applications/petitions for routes, within the Cordillera Administrative Region. However, applications/petitions for routes extending beyond its territorial jurisdiction shall be heard and decided by the Board (LTFRB) [Section 21, Chapter 5, Title XV, E.O. No. 2921]

“4.1.6 The administration, supervision and operation of the Loakan Airport, Baguio City shall be transferred to the DOTC-CAR with the Airport Manager acting as Staff Officer for Air Transportation to the Regional Director.”

All orders, memoranda and other pertinent issuances inconsistent herewith are hereby modified and/or revoked accordingly.

This Order shall take effect immediately.
