[ BAI MEMORANDUM ORDER NO. 07, S. OF 2010, March 04, 2010 ]

LIFTING THE TEMPORARY BAN ON THE IMPORTATION OF DOMESTIC AND WILD BIRDS AND THEIR PRODUCTS INCLUDING POULTRY MEAT, DAY OLD CHICKS, EGGS AND SEMEN ORIGINATING FROM FRANCE



WHEREAS, based on the report submitted to the Office International des Epizooties (OIE) by Dr. Jean Luc Angot, Directeur General Adjoint, Direction Generale de l’Alimentation, Ministere de l’Agriculture et de la Pecge, Paris, France, last 17 December 2009. France declares that the Low Pathogenic Avian Influenza (LPAI) incident has been successfully eradicated;

WHEREAS, final cleaning and disinfection operations were completed on 2 December 2009;

WHEREAS, in accordance to Article 10.4.3 of the OIE Terrestrial Animal Health Code (2008), France regain its notifiable avian influenza free country status on 2 March 2010;

WHEREAS, based on the evaluation of the Bureau of Animal Industry (BAI), the risk of contamination from importing poultry and poultry products from France is negligible;

NOW, THEREFORE, I, ATTY, BERNIE G. FONDEVILLA, Secretary of Agriculture, by the powers vested in me by law, do hereby lift the temporary ban on the importation of domestic and wild birds and their products including poultry meat, day old chicks, eggs and semen originating from France.

All import transactions of the above products shall be in accordance with the existing rules and regulations of the Department of Agriculture, Bureau of Animal Industry and National  Meat Inspection Service (DA-BAI-NMIS).

All orders, rules and regulations or parts thereof, which are inconsistent with the provisions of this order, are hereby repealed or amended accordingly.

This Order shall take effect immediately.
