[ DPWH DEPARTMENT ORDER NO. 99, April 19, 1991 ]

ADDITIONAL CONDITIONS FOR THE INTERIM OPTION FOR CONSTRUCTORS TO SUSPEND WORK OPERATIONS



Further to Department Order No. 47, series of 1991 and pursuant to the letter dated 17 March 1991 of the Secretary of Socio-Economic Planning and Director General, National Economic and Development Authority, the following are the additional conditions where the contractor will have the option to suspend work if there is no Government response within fifteen (15) calendar days from the date of a written notice from the contractor:

1.  Delay in the payment of contractor’s claim beyond forty-five (45) calendar days from the time the contractor’s claim has been supported by a certification by the Government’s field representative that the billing documents are complete; and

2.  Lack of approval/disapproval of variation orders involving activities necessary for the completion of the project as endorsed by the Government field representative in charge of the project after forty five (45) days from submission thereof to the concerned offices.

This Department Order shall take effect immediately.
