[ LTFRB MEMORANDUM CIRCULAR NO. 89-011, March 15, 1991 ]

PROHIBITION AGAINST REGISTRATION OF NEW UNIT IN LIEU OF THE UNIT AUTHORIZED IN THE DECISION WITHIN ONE (1) YEAR FROM DATE THEREOF



Effective immediately, petitions to register a new unit in lieu of the unit authorized in the decision is hereby prohibited if filed within one (1) year from the date of the decision, except for any of the following grounds which are beyond the control of the operator:

1. The unit to be replaced is wrecked by accident, fire, or other natural disaster causing serious defects on the unit which are beyond repair;

2. The unit to be replaced has been stolen and not recovered; and

3. Non-delivery of the unit or delivery of a different unit by the motor company.

Petitions based on any of the above grounds shall be accepted and processed only if accompanied by (a) the operator’s affidavit and documents to prove beyond doubt the ground relied upon, and (b) a certification of the LTO registering agency that the unit involved has not been registered yet.

If the ground for replacement is unserviceability of the unit (No. 1), the same must be made available for inspection by the Board’s technical personnel.

This Memorandum Circular takes effect immediately.
