ISSUANCE OF PROFESSIONAL’S LICENSE IN LIEU OF PROFESSIONAL’S REGISTRATION CARD



WHEREAS, the Section 5 (a), PD 223 provides that one of the main powers of the Commission is “to administer, implement, and enforce the regulatory policies of the National Government with respect to the regulation and licensing of the various professions under its jurisdiction including the maintenance of professional standards and ethics and the enforcement of the rules and regulations relative thereto;”

WHEREAS, pursuant to Section 5(u) of the same law, the Commission is empowered “to promulgate such rules and regulations as may be necessary to effectively implement policies with respect to the regulation and practice of the profession;”

WHEREAS, in addition to the Certificate of Registration which is issued upon passing the board examination and meeting all legal requirements for admission to the profession concerned, the Commission also issues a Professional’s Registration/Identification Card to all practicing professionals who must register with the Commission every three years;

WHEREAS, the practice of a profession is not a right but a mere privilege granted to the licensee who must show evidence that he or she has maintained an acceptable level of current professional knowledge by complying with continuing professional education requirements prescribed in his/her profession;

WHEREAS, the Professional Registration/Identification Card serves as evidence that the person named therein has complied with the prescribed continuing professional education requirements and is therefore duly registered and licensed to practice the profession indicated therein;

WHEREAS, there is a need to indicate the true nature of the Professional Registration/Identification Card by changing it into a Professional’s License and specifying requirements for its effectively and manner of renewal;

NOW THEREFORE, BE IT RESOLVED, as it is hereby resolved:

1. That in lieu of a Professional Registration/Identification Card, the Commission shall issue a Professional’s License to practicing professional who have complied with regulatory requirements and paid the prescribed registration/license fee;

2. That each Professional License shall contain the full name and profession of the licensee, a serial number, the registration and expiry dates, and a recent ID bust photograph of the licensee affixed and sealed on the upper left-hand corner thereof.  The license shall be signed by the licensee and the Chairman of the Commission and shall carry the official seal of the Commission;

3. That the serial number of each professional license shall be the number appearing on the licensee’s certificate of registration followed by the last two digits of the year in which the license expires;

4. That pursuant to LOI 567, the professional license shall, unless sooner revoked or suspended for cause, be valid for a three year period starting on the registration date and ending on the expiry date which shall be the birth date of the licensee in the third year;

5. That the professional license should be renewed not later than the twentieth day of the next month following its expiry date;

6. That, if the professional license is not renewed within the prescribed period, a 20% surcharge shall be imposed, in addition to the registration/license fee; and,

7. That upon its approval, the Commission shall implement this resolution by taking appropriate administrative actions against delinquent professionals and requesting all private and government entities concerned to ascertain that the professionals they employ or deal with have valid professional licenses to practice their respective professions.
