AMENDMENT TO MEMORANDUM ORDER NO. AFF-2006-021 (7 DECEMBER 2006)

Due to the nationwide network of the National Bureau of Investigation’s database, it has been a reliable source for checking if an alien to be deported is subject of a criminal investigation or case. The procurement of the Philippine National Police and Regional Trial Court clearances have become unessential and have consumed valuable time in the implementation of many deportation orders. Such situation has unduly exposed the Bureau to allegations of human rights violation specifically unjustified prolonged detention of aliens who are subject of deportation proceedings.

Hence, memorandum Order No. AFF-2006-021 (7 December 2006,) Rule VII-a, 2nd paragraph to wit:

“The Special Prosecutor shall then transmit a certified true copy of the charge sheet to the BI-Intelligence division, which shall be tasked to procure the necessary clearances for deportation from the National Bureau of Investigation (NBI), Philippine National Police (PNP and regular courts and/or other clearances/documents relative to the deportation case.”

is hereby Amended AS FOLLOWS:

The Special Prosecutor shall then transmit a certified true copy of the charge sheet to the BI-Intelligence Division, which shall be tasked to procure the necessary National Bureau of Investigation (NBI) clearance to ensure that the alien to be deported is not a subject of a criminal case.

This amendment shall take effect 15 days from receipt of the parties concerned.
