IMPLEMENTING RULES AND REGULATIONS OF REPUBLIC ACT NO. 8757, OTHERWISE KNOWN AS AN ACT ESTABLISHING THE PHILIPPINE SPORTS HALL OF FAME AND APPROPRIATING FUNDS THEREFOR



PRELIMINARY PROVISIONS

Pursuant to the mandate given to the Philippine Sports Commission under Section 6 of Republic Act 8747, otherwise known as the Philippine Sports Hall of Fame Act of 1999, the following rules and regulations are hereby promulgated and issued to implement the provisions of the said act for guidance and compliance by all concerned.

RULE I
[GENERAL  PROVISIONS]
TITLE, PURPOSE AND CONSTRUCTION


SECTION 1. Title and Purpose. These rules shall be referred to as the “Implementing Rules and Regulations of Republic Act No. 8757”, otherwise known as “An Act establishing the Philippine Sports Hall of Fame and providing funds therefor”. These rules are hereby promulgated to govern the nomination and enshrinement of qualified athletes, coaches and trainers to the Philippine Sports Hall of Fame.

SECTION 2. Statement of Policy. The State shall promote excellence in sports to uplift the life of all Filipinos. It shall acknowledge and recognize the efforts of athletes, coaches and trainers  who have garnered international prestige and instilled national pride by winning in international competitions such as the Southeast Asian Games, Asian Games, Asian Cup or regional games, Olympic or World Games or World Championship Games. Further, to promote excellence in sports, recognition and reverence is awarded to those sporting greats who made remarkable achievements in their particular field of sport as well as inspire the Filipino nation

SECTION 3. Construction. Any doubt in the interpretation of these Rules shall be resolved by the Philippine Sports Commission.

RULE II
DEFINITION OF TERMS


SECTION 4. Definition of Terms - As used herein, the following terms shall be defined as follows:

(a) Act - refers to Republic Act No. 8757, otherwise known as “An Act establishing the Philippine Sports Hall of Fame and providing funds therefore”.

(b) Athlete - refers to a Filipino amateur athlete who has represented the Philippines and won in any international competition as defined in letter (c) hereof: Provided, that the athlete has been or is a member of the Philippine National Team, and recognized and accredited as such by the Philippine Sports Commission (PSC) and the Philippine Olympic Committee (POC); and

The term shall also refer to a former Filipino professional athlete who had represented the Philippines and won in any international competition  as provided herein, provided that the athlete had been accredited and recognized by the Games and Amusement Board (GAB).

(c) Coach and Trainer - refers to a Filipino coach and/or trainer who was a member or former member of the national coaches and trainers, recognized and accredited by the PSC and the POC, and has represented the Philippines as an official coach and/or trainer of the athletes or teams who won in international competitions as provided herein.

(d) Games and Amusements Board (GAB) - refers to the government regulatory body that governs the conduct of all professional sports and games locally and the activities of professional athletes, game officials and officiating sports personnel.

(e) International competitions - refer to the Southeast Asian Games, Asian Games, Asian Cup or regional games, Olympic Games and World Championship Games.

(f) Philippine Olympic Committee (POC) - refers to the private, non-governmental organization which serves as the National Olympic Committee in the Philippines.

(g) Commission - refers to the Philippine Sports Commission (PSC), the sole policy-making and coordinating body of all amateur sports development programs and institutions in the Philippines.

(h) Philippine Sports Hall of Fame or Hall of Fame - refers to the group of athletes, coaches and trainers who have distinguished themselves in their particular field of sport and have provided invaluable contribution to sports development and promotion and adjudged outstanding, famous and illustrious based on the criteria set forth in the Act.

RULE III
ESTABLISHMENT AND COVERAGE


SECTION 5. Establishment of the Philippine Sports Hall of Fame - The Philippine Sports Hall of Fame is hereby created to enshrine Filipino athletes, coaches and trainers who have distinguished themselves in their particular field of sport. The Hall of Fame is also established to inspire the Filipino people and instill national pride by disseminating the stories of these outstanding athletes, coaches and trainers and their remarkable achievements.

SECTION 6. Coverage - Any Filipino athlete who has achieved at least any of the following feats in his/her particular field of sport and any Filipino Coach or Trainer who mentored or trained any of the following:

a. Gold medalist in any Southeast Asian Games
b. Silver medalist in any Asian Games or Asian Cup or regional games
c. Bronze medalist in any Olympic or World Games or
d. Title holder In World Championship Games

RULE IV
REQUIREMENTS FOR NOMINATION


SECTION 7. Requirements for Nomination of Athletes. To be eligible for nomination to the Philippine Sports Hall of Fame, a living/deceased athlete must be:

a. Recommended by any individual, relevant group or association;
b. A member or was a member of the Philippine National Team as certified by the PSC
and the POC or a professional athlete as certified by the GAB; and
c. A Gold medalist in any Southeast Asian Games, or a Silver medalist in any Asian Games or Asian Cup or regional games or a Bronze medalist in any Olympic or World Games or a titleholder in any World Championship Games.

SECTION 8.  Requirements for Nomination of Coaches/Trainers. To be eligible for nomination for the Philippine Sports Hall of Fame, a living/deceased Coach/Trainer must be:

a. Endorsed or recommended by any individual, relevant group or association;
b. A coach or trainer or was a coach or trainer of the Philippine National Team as certified by the PSC and POC or the GAB for coaches and trainers of professional athletes;
c. A coach or trainer who mentored or trained an athlete who has been at least a Gold medalist in any Southeast  Asian Games, or a Silver medalist in any Asian Games or Asian Cup or regional games or a Bronze medalist in any Olympic or World Games or a titleholder in any World Championship Games.

RULE V
SCREENING COMMITTEE


SECTION 9. Screening Committee. A Screening Committee is hereby established, to undertake the following:

a. To promulgate the criteria for nomination and selection of candidates for the Hall of Fame;
b. To promulgate its internal rules and procedure governing the nomination, selection and election/enshrinement processes;
c. To accept nominations to the Philippine Sports Hall of Fame;
d. To screen nominees thereof; and
e. To vote and enshrine the nominee to the Hall of Fame.

SECTION 10.  Composition. The Screening Committee shall be comprised of the following:

a. The Chairman of the Philippine Sports Commission (PSC) who shall sit as Chairman;
b. The President of the Philippine Olympic Committee (POC) as Vice-Chairman;
c. Chairman of the Games and Amusement Board (GAB) as member;
d. Two (2) members from the POC-Accredited national sports associations who shall be selected by the general assembly;
e. Two (2) members from credible and prestigious sports organizations or organizations representing the private sector such as media, sports clubs, athletic associations, leagues who shall be selected by the PSC, in a meeting en banc, upon recommendation of relevant groups and individuals;

SECTION 11. Screening Committee Secretariat. The Screening Committee shall have a secretariat that shall be designated by the Commission to receive, accept, collate and keep the records of all nominations and other documents submitted to the Screening Committee including records of meetings or consultation. The Secretariat shall provide technical and administrative assistance to the Committee in the conduct of meetings or consultations and other activities in the performance of the Committee’s tasks.

RULE VI
FORMAL INDUCTION CEREMONY


SECTION 12. Induction Ceremony. The Philippine Sports Commission, as the lead agency, shall undertake to hold a formal induction ceremony once every two (2) years to honor those who will be installed in the Philippine Sports Hall of Fame. A medal, trophy or plaque of recognition, to be determined by the Commission, shall be awarded during the ceremony in recognition and confirmation of those elected to the Hall of Fame.

RULE VII
FUNDING


SECTION 13. Funding. The amount necessary for the effective implementation of Republic Act No. 8757 shall be provided by the Philippine Sports Commission under its current General Appropriations Act (GAA) budget allocation. Thereafter, such amount as may be necessary for its continuous implementation shall be included in the subsequent annual General Appropriations Act.

RULE VIII
FINAL PROVISIONS


SECTION 14.  Amendment. As the need arises, these Implementing Rules and Regulations may be amended by the Screening Committee.

SECTION 15. Separability Clause. If any of the provision in this IRR, or application of such provision to any circumstances, is declared invalid or unconstitutional, the other provisions not affected thereby shall remain valid and subsisting.

SECTION 16. Repealing Clause - All orders, circulars, memoranda, rules and other issuances or parts thereof, inconsistent with the provision of these Implementing Rules and Regulations are hereby repealed, amended or modified accordingly.

SECTION 17. Effectivity Clause. These rules shall take effect fifteen (15) days after its publication in a newspaper of general circulation.
