[ BAI MEMORANDUM ORDER NO. 12, S. OF 2010, March 25, 2010 ]

LIFTING THE TEMPORARY BAN ON THE IMPORTATION OF DOMESTIC AND WILD BIRDS AND THEIR PRODUCTS INCLUDING POULTRY MEAT, DAY OLD CHICKS, EGGS AND SEMEN ORIGINATING FROM GERMANY



WHEREAS, based on the report submitted to the Office International des Epizooties (OIE) by Dr. Karin Schwabenbauer, Ministerial Dirigent and Chief Veterinary Officer, Directorate of Animal Health and Food Hygiene, Bundesministerium fur Emahrung, Landwirtschaft und Verbraucherschutz (BMELV), Bonn, Germany, 5 January 2010, Germany declares that the Low Pathogenic Avian Influenza (LPAI) incident has been successfully eradicated;

WHEREAS, disinfection of infected premises and establishments were done and the date of event was resolved on 21 December 2009;

WHEREAS, Germany regained its status in accordance to Article 10.4.3 of the OIE Terrestrial Animal Health Code (2008);

WHEREAS, based on the evaluation of the Bureau of Animal Industry (BAI), the risk of contamination from importing poultry and poultry products from Germany is negligible;

NOW, THEREFORE, I, ATTY. BERNIE G. FONDEVILLA, Secretary of Agriculture, by the powers vested in me by law, do hereby lift the temporary ban on the importation of domestic and wild birds and their products including poultry meat, day old chicks, eggs and semen originating from Germany.

All import transactions of the above products shall be in accordance with the existing rules and regulations of the Department of Agriculture, Bureau of Animal Industry and National Meat Inspection Service (DA-BAI-NMIS).

All orders, rules and regulations or parts thereof, which are inconsistent with the provisions of this order, are hereby repealed or amended accordingly.

This ORDER shall take effect immediately.
