[ PPA ADMINISTRATIVE ORDER NO. 09-99, September 21, 1999 ]

REDUCED TRANSSHIPMENT TARIFF ON CONTAINERIZED CARGOES



1. AUTHORITY

1.1 Section 20 (a) of Presidential Decree No. 857, as V amended.

1.2 Board Resolution No. 99-657.

2. SCOPE

This Order shall apply to all government ports under the jurisdiction of the Philippine Ports Authority.

3. RATIONALE

To encourage the development of the foreign transshipment market, especially in the Port of Manila, wharfage dues for foreign containerized transshipment shall be reduced.

4. GUIDELINES

4.1 The reduced wharfage charge shall cover only foreign containerized transshipment. Such foreign containerized transshipment shall refer to containerized cargoes discharged at the port from a foreign port and destined for reshipment to another foreign ports as declared in the manifest.

4.2 Wharfage fee shall be $1.00 per TEU.

4.3 There shall be no minimum volume requirement per carrying vessel for a shipping line to avail itself of the reduced tariff.

4.4 Arrastre charges shall not be imposed by the cargo handler except when the cargo contents of such containers are rehandled at the port.

4.5 Storage fees as well as full vessel charges shall be charged per existing tariff as provided for under PPA MC No. 07-94.

4.6 Effects of this Administrative Order shall be closely monitored by the Port Managers. Six months after its effectivity, the Port Managers shall submit to the Office of the AGM for Operations Attn: CSD a detailed report on the volume of transshipment and total revenue collected therefrom, including vessel charges, as compared with the preceeding period.

5. REPEALING CLAUSE

All PPA issuances, Memoranda, Circulars, Orders, rules and regulations, policies or parts thereof inconsistent with or contrary to any of the provisions of this Order are hereby modified or repealed.

6. SEPARABILITY CLAUSE

If, for any reason, any Section or provision of this Order is declared to be unconstitutional or invalid, the other sections or provisions of the same which are not affected thereby shall continue to be in full force and effect.

7. EFFECTIVITY

This Order shall take effect fifteen (15) days after its publication in any newspaper of general circulation.
