[ MIA MEMORANDUM CIRCULAR NO. 204, April 21, 2005 ]

ASSUMPTION OF FUNCTIONS UNDER R.A 9295



Pursuant to Section 10 of Republic Act 9295, otherwise known as the Domestic Shipping Development Act of 2004, and Section 2, Rule XVIII of its Implementing Rules and Regulations, Notice is hereby given that the following functions shall be exercised by the Maritime Industry Authority (MARINA) effective June 11, 2005:

    1. Registration of vessels, including other documentation;
    2. Setting of safety standards for vessels in accordance with applicable conventions and regulations;
    3. Requiring all domestic ship operators to comply with operational and safety standards for vessels set by applicable conventions and regulations, maintain its vessels in safe and serviceable condition, meet the standards of safety of life at sea and safe manning requirements and furnish safe, adequate, efficient, reliable and proper service at all times; and
    4. Inspection of all vessels to ensure and enforce compliance with safety standards and other regulations.

The Provision of Item V of MARINA Memorandum Circular No. 139 and all other existing circulars, rules and regulations which are inconsistent with this Circular are hereby repealed.

This Memorandum Circular shall be published in a newspaper of general circulation.
