AMENDING SRA SUGAR ORDER NO. 8, SERIES OF 1992-1993, DATED FEBRUARY 18, 1993



WHEREAS, Section 2(a) of SRA Sugar Order No. 8, Series of 1992-1993, dated February 18, 1993, provides for the consolidated quedanning of planters' share of "C" or Reserve sugar in the name of their respective planters associations/cooperatives;

WHEREAS, after consultations with planters associations/cooperatives presidents, it has been recommended that quedanning of planters' share of said "C" or Reserve sugar be either consolidated in the name of the planters' association/cooperative or in the individual planters' names, at the option of the planters' association/cooperative;

NOW, THEREFORE, under and by virtue of the powers vested in the Sugar Regulatory Administration, it is hereby ordered:

SECTION 1.       Section 2 of SRA Sugar Order No. 8, Series of 1992-1993, dated February 18, 1993, is hereby amended to read as follows:
"Section 2     (a) At the option of planters' associations/cooperatives in the mill district, the mill companies shall, on a weekly basis, issue either consolidated "C" or Reserve sugar quedan-permits on planters' share or "C" quedan-permits in the individual planter's name.  The planters association/cooperative shall advise in writing the mill company concerned of the option they have taken, copy furnished the SRA Mill District Regulation Officer.

(b)     In case the option of the planters' association/cooperative is for consolidated quedanning, the mill company concerned shall issue consolidated "C" quedan-permits on the planters' share in the name of their association/cooperative, with an attached listing of the individual planters and their respective shares.

In the case of financed planters, the mill company may segregate and group said planters according to financing bank/institution and issue separate but still consolidated "C" quedan-permits in the name of the association/cooperative as provided in the preceding paragraph.

Similarly, in the case of non-financed or "free" planters, the mill company may segregate and group said planters and issue separate but still consolidated "C" quedan-permits in the name of the association/cooperative as provided in the preceding paragraphs.

(c)     Non-affiliated planters shall be issued individual "C" quedan-permits."
SECTION 2. Planters' associations/cooperatives which opt for individual quedanning of their members' "C" sugar under this Sugar Order shall surrender to the mill company concerned their previously issued consolidated "C" quedan-permits for cancellation and replacement with individual "C" quedan-permits.

SECTION 3. The "D" or World Market sugar production shall continue to be issued consolidated "D" quedan-permits as provided in SRA Sugar Order No. 1, Series of 1992-1993, dated September 3, 1992.  However, the provisions of said Sugar Order on consolidated quedanning of "D" sugar are hereby amended and revised accordingly to conform with the provisions of this Sugar Order on consolidated quedanning of "C" sugar.

In the case of non-affiliated planters, the quedanning of their "D" sugar shall, at their option, be either joined with any planters association/cooperative in the mill district or with the mill company.  The said planters may be segregated and grouped under a separate but still consolidated "D" quedan-permits in the name of the association/cooperative of their choice or the mill company, as the case may be.

SECTION 4. This Sugar Order shall take effect retroactively to sugar production beginning February 22, 1993.

SECTION 5. Provisions of sugar orders, circular letters, rules and regulations contrary to or inconsistent with this Sugar Order are hereby revoked, amended, or revised accordingly.
