[ LTFRB MEMORANDUM CIRCULAR NO. 2005-054, December 06, 2005 ]

SUPPLEMENTING AND AMENDING CERTAIN PROVISIONS OF MEMORANDUM CIRCULAR 2005-023 RELATIVE TO THE P2P (AUV/VAN) EXPRESS CONVERSION PROGRAM TO COVER MEGA TAXI, METERED TAXI AND AIRCONDITIONED TAXI SERVICES UNDER THE 2ND PHASE IMPLEMENTATION SCHEDULE



The following supplemental and amendatory provisions of Memorandum Circular 2005-023 are hereby rendered to ensure increased stakeholder participation under the P2P (AUV/VAN) Conversion Program:

    1. AUV vehicles (Toyota FX/Revo, Isuzu Highlander, Mitsubishi Adventure) covered under subsisting Mega Taxi, Metered Taxi and Air-conditioned Taxi franchises with year models from 1994 to present shall be considered under the 2nd Phase of the P2P (AUV/VAN) Express Conversion Program. However, for those AUV units with year models from 1994 to 1997, the expiry date of the franchises shall coincide with the age maturity of the unit(s) which is thirteen (13) years reckoned from the date of manufacture. The scheduled date of implementation shall be on 07 January 2006.

    2. Simultaneous Sale and Transfer with Dropping and Substitution shall not be allowed as provided under Memorandum Circular 2005-047 except those covered under MC 2004-030 Re: Substitution of Taxi and Mega Taxi units.

    3. Compliance with the "all White" Color Scheme shall be undertaken to coincide with the unit inspection and installation of markings and decals by the 2nd semester of 2006 with corresponding plate number ending on the following schedule:

    4. Compliance with the Schedule and Procedure of Payment of Compromise Conversion Fee amounting to P30,000.00 shall be undertaken based on the following schedule and options:

      4.1 Full payment of 30,000.00 upon Filing of Application

      4.2 Installment Plan

        a. Two Partial Payment Scheme

         

        - P15,000.00 upon filing of application
          - P15,000.00 upon inspection of color scheme compliance

        b. Four (4) Partial payment Scheme

         

        - P7,500.00 upon filing of application
          - P7,500.00 upon appearance during hearing
          - P7,500.00 upon release of decision/order
          - P7,500 upon inspection of color scheme compliance

Other rules and regulations that are inconsistent with the provisions of this Memorandum Circular are hereby repealed and/or modified accordingly.

This Memorandum Circular supersedes any and all issuances inconsistent herewith, and takes effect fifteen (15) days following the filing of three (3) copies hereof with the UP Law Center, pursuant to Presidential Memorandum Circular No.11, dated 09 October 1992.
