ISSUANCE OF SPECIAL PERMIT TO OPERATE SHIPS IN THE DOMESTIC TRADE DUE TO MERITORIOUS CIRCUMSTANCES



Pursuant to Section 1.(1.5), Rule II of the Implementing Rules and Regulations (IRR) of Republic Act (RA) 9295, authorizing the MARINA to require any domestic shipping operator to provide shipping services to any coastal area, island or region in the country and to ensure the uninterrupted service of ships in the domestic trade specially during peak season, the following guidelines are hereby promulgated:

I. Coverage

This Advisory shall cover all shipowners/operators with valid Certificate of Public Convenience (CPC) to operate Philippine-registered domestic liner ships carrying passengers and/or cargoes.

II. Instances Covered

The issuance of Special Permit (SP) shall be warranted under the following circumstances:

    a. to meet emergency situation; or,
    b. force majeure; or,
    c. when public interest so requires to be determined by MARINA.

III. Number of days of the Special Permit (SP)

    1. A Special Permit shall be issued for a maximum period of seven (7) days.

    2. The following documentary requirements shall be submitted/ complied with:

      a. Letter of Intent with Application for Issuance of SP stating the reasons(s) and attaching therein relevant documents to evidence the reason for SP;

      b. Valid ship documents/ship safety certificates required under pertinent Sections of the Implementing Rules and Regulations (IRR) of Republic Act (RA) 9295, as applicable; and,

      c. Proof of Payment of Processing Fee(s) pursuant to MARINA Memorandum Circular No. 183 and its subsequent amendments.
