RECKONING DATE OF THE SEVEN (7) DAYS WITHIN WHICH TO REGISTER A MOTOR VEHICLE



Section 56 (a) of the Republic Act 4136 states that:

"For registering later than seven days after acquiring title to an unregistered motor vehicle or after conversion of a registered motor vehicle requiring larger registration fee than that for which it was originally registered, or for renewal of a delinquent registration, the penalty shall be a fine fifty percent of the registration fees corresponding to the portion of the year for which the vehicle is registered for use." (Underscoring supplied).

Pursuant to the above-cited provision of the law, Memorandum Circular No. 509-2004 is hereby reiterated. Thus, the document to be used as proof of "acquiring title" over a motor vehicle and which shall also be the basis for the reckoning of the 7th DAY PERIOD FOR THE APPLICATION OF THE FIFTY PERCENT PENALTY FOR LATE INITIAL REGISTRATION are the following:
1) Sales Invoice-for completely built unit (CBU)/wholly purchased and never, been registered with the Land Transportation Office.

2) Affidavit of Rebuilt-for rebuilt unit.
In view hereof, all officials and employees concerned are hereby directed not to accept the above documents if the date of its issuance or execution is not indicated, with erasures, with super-imposition, or traces of alteration.

This Memorandum Circular shall take effect immediately and all other issuance that are in conflict herewith are hereby superseded.
