[ NTC MEMORANDUM CIRCULAR NO. 01-03-2008, March 03, 2008 ]

AMENDING FURTHER MEMORANDUM CIRCULAR NO. 4-3-99 (IMPLEMENTING GUIDELINES ON INTERNATIONAL SATELLITE COMMUNICATIONS), AS AMENDED (BY MEMORANDUM CIRCULAR NO. 5-6-2003)



Pursuant to Republic Act No. 7925 (Public Telecommunications Policy Act of 1995), Act No. 3846, as amended, Radio Control Law, and E.O. No. 467 Series of 1998, the Mational Telecommunications Commission hereby amends the last paragraph of Section of Memorandum Circular (MC) No. 4-3-99, as amended, as follows:
"provided further, that entities engaged solely in research development, education, health, safety and/or rescue shall be allowed direct access to international fixed and/or land mobile satellite systems.

Provided even further, that entities engaged solely in research and development, education, health, safety and/or rescue may be allowed direct access to any international fixed and/or land mobile satellite systems subject to strict compliance of the terms and conditions that shall be imposed by the Commission. It includes, but is not limited to, the following terms and conditions:
  1. The applicant shall not provide commercial satellite access to the public;

  2. The equipment in the Philippines shall only be used in research development, education, health, safety, and rescue;

  3. The operation of the equipment must be on a non-interference basis;

  4. Applicant shall submit a favorable endorsement of its application from the concerned government agency/ies (e.g. Department of Education Culture and Sports (DECS), Department of Health (DOH), Department of National Defense (DND), etc.) and/or from the local government unit/s where the equipment is to be used/operated;

  5. Applicant shall submit a copy of its Securities and Exchange Commission (SEC) Certificate of Registration;

  6. Applicant shall submit a copy of its latest Annual Income Tax Return, duly stamped "received" by the Bureau of Internal Revenue (BIR);

  7. Applicant or its duly authorized representative shall certify under oath that each of the documents submitted is an original copy or a certified true copy of the original; and

  8. For foreign entities, it is necessary that the Department of Foreign Affairs (DFA) attest to the affiliations of the applicant and endorses its application.
Any Circular, Order, or any part thereof inconsistent herewith is deemed amended and/or superseded accordingly.

This Circular shall take effect fifteen (15) days after publication in a newspaper of genera! circulation and three (3) certified true copies furnished the UP Law Center.
