(NAR) VOL. 16 NO. 4 / OCTOBER - DECEMBER 2005

[ POEA ADVISORY NO. 15, S. 2005, September 16, 2005 ]

RECOGNITION OF VISAS OTHER THAN WORK / EMPLOYMENT VISAS/PERMITS FOR OFW MOBILIZATION

In order to facilitate the mobilization of Filipino workers who are offered overseas employment but will be deployed through the use of visas other than work/employment, the POEA hereby allows the registration of principals and documentation of overseas Filipino workers who use such visas.

Recruitment agencies shall disclose to POEA the use of these visas upon application for the registration of their principals or request for approval of job orders. The agencies shall submit a letter guaranteeing that the work visas of their workers shall be applied at the worksite and thereafter inform POEA when the work visas are issued, for monitoring purposes. The repatriation of the worker in case the work visa is not approved by the host country shall be at the cost of the employer.

The deploying agency shall be responsible for the workers being deployed using such visas, in accordance with Philippine Labor Laws, Rules and Regulations.

For information and guidance.
