AMENDMENT TO ADMINISTRATIVE ORDER NO. 8, SERIES OF 1991, ENTITLED "AMENDMENTS TO ADMINISTRATIVE ORDER NO. 2, SERIES OF 1991, ENTITLED "RULES AND REGULATIONS ON SUMMARY ADMINISTRATIVE PROCEEDINGS ON LAND COMPENSATION"



Amendment to Administrative Order No. 8, Series of 1991, Entitled "Amendments to Administrative Order No. 2, Series of 1991, Entitled "Rules and Regulations on Summary Administrative Proceedings on Land Compensation"

SECTION 1.       The last sentence of Section 1 of Administrative Order No. 8, Series of 1991, as amended by Administrative Order No. 2, Series of 1991, is further amended to read as follows:
x x x Where the total amount of compensation being offered by the government to the landowner does not exceed TWO MILLION PESOS (P2,000,000.00), the proceedings shall be conducted by the Provincial Agrarian Reform Adjudicator (PARAD) concerned.  Where the compensation so offered is TWO MILLION PESOS (P2,000,000.00) BUT NOT MORE THAN FIVE MILLION PESOS (P5,000,000.00), the proceedings shall be handled by the Regional Agrarian Reform Adjudicator (RARAD).  If the amount exceeds FIVE MILLION PESOS (P5,000,000.00) the proceedings shall be conducted at the DARAB Adjudication Board Central Office.
SECTION 2.       The decision of the PARAD, RARAD and DARAB on preliminary determination of just compensation shall be final and executory if no original action is filed by the party-in-interest to the Special Agrarian Court within fifteen (15) days from receipt of the decision pursuant to Section 16, paragraph "e", of Republic Act No. 6657.

SECTION 3.       All Orders/Circulars and/or Memoranda which are inconsistent herewith are hereby amended, modified or revoked as the case may be.

SECTION 4.       This Administrative Order shall take effect after ten (10) days from publication in two (2) national newspapers of general circulation.

SECTION 5.       The PARADs and the RARADs shall continue hearing and deciding cases within their former jurisdictional amounts, which have been endorsed to their offices prior to the effectivity of this Administrative Order.  After the effectivity of this Administrative Order, contested valuation cases shall be forwarded to the PARADS, RARADs or DARAB Central Office, in accordance with the guidelines contained herein.
