Guidelines on the Cooperative Development Councils 

Pursuant to Article 2 of the Cooperative Code of the Philippines and Executive Order No. 95, series of 1993, the following guidelines are hereby adopted in the formation of the Cooperative Development Councils, under the aegis of the Cooperative Development Authority (CDA).

A
Legal Basis of the Councils

The establishment of Cooperative Development Councils is authorized under Executive Order No. 95, series of 1993 at the national, regional, provincial and city/municipal levels.  Such councils are also impliedly authorized under Article 2 of the Cooperative Code which states that "x x x.  The State shall encourage the private sector to undertake the actual formation and organization of cooperatives, and shall create an environment that is conducive to the growth and development of these cooperatives."

Functions and Powers of the Council

The council shall have the following functions and powers:

1.  To assist in the formulation of policies on cooperatives development within the areas of such councils;

2.  To harmonize and monitor the implementation of various cooperative development plans and projects;

3.  To operationalize and monitor the Cooperative Medium Term Development Plan (CMTDP) through the efforts of all sectors, and to develop such development plans as may be required in line with the CMTDP;

4.  To share scarce resources towards the full realization of such development plans;

5.  To serve as a forum for the discussion of various problems, issues and concerns affecting cooperatives within the area and to propose solutions to them.

6.  To recognize and promote the observance of the principle of subsidiarity and the universal cooperative principles as embodied in the Cooperative Code of the Philippines in the performance of the above functions.

Composition and Structure of the Councils

The councils shall be composed of the following:

1.         National Cooperative Development Council

a.  Representatives of the national government agencies with cooperative development programs, including government financial institutions;

b.  National presidents of formal aggrupations of local government units such as the Governors League of the Philippines, Vice-Governors League of the Philippines, City Mayors League of the Philippines, City Vice-Mayors League of the Philippines, Municipal Mayors League of the Philippines, Municipal Vice-Mayors League of the Philippines, Board Members League of the Philippines, City Councilors League of the Philippines, Municipal Councilors League of the Philippines, National Association of Barangay Councils and others;

c.  Representatives of non-government organizations in the national level upon invitation by the chairman of the council;

2.         Regional Cooperative Development Councils

a.  The regional directors of the national government agencies which are concerned with cooperative development, including government financial institutions;

b.  Cooperative leaders of the regional federations and unions, icluding non-government organizations operating in the area upon invitation by the chairman of the council;

c.  Chairman of the Regional Development Council.

3.         Provincial Cooperative Development Council

a.  Chairman of the Provincial Development Council;

b.  Representative of the Sangguniang Panlalawigan;

c.  Representatives of government financial institutions operating in the area;

d.  Cooperative leaders of the provincial federations and unions, including non-government organizations in the provincial level;

e.  Representatives of other government organizations involved in cooperative development.

4.         City/Municipal Cooperative Development Council

a.  Chairman of the City/Municipal Development Council;

b.  Representative of the Sangguniang Panglungsod/Bayan;

c.  Cooperative leaders of the city/municipal federations and unions, including non-government organizations in the city/municipal level.

d.  Representatives of other government agencies involved in cooperative development.

The council may create such committees that will make coordination more effective.

The CDA shall be the Vice-Chairman of the council at all levels and provide coordinative and secretariat services to the councils.  The Chairman of the council shall be chosen from among the members, His term shall be for a period of not more than one year.

The council shall meet at least once a month on date and place agreed upon by the members present.  The decision of the council shall be by consensus.

Effectivity

These guidelines shall be effective upon approval by the CDA Board of Administrators.
