[ CESB RESOLUTION NO. 726, March 14, 2008 ]

THE REVISED GUIDELINES ON THE REACTIVATION OF CAREER EXECUTIVE SERVICE RANKS



WHEREAS, Article IV, Part III of the Integrated Reorganization Plan (IRP), as approved by Presidential Decree No. 1 dated September 24,1972, as amended, expressly provides that the Career Executive Service (CES) is created to form a continuing pool of well-selected and development oriented career administrators who shall provide competent and faithful service;

WHEREAS, the above-said law also created the Career Executive Service Board (CESB) to serve as the governing body of the CES and is mandated to promulgate rules, standards and procedures, on the selection, classification, compensation and career development of members of the CES;

WHEREAS, it is also provided that "a person who meets such managerial experience and other requirements and passes examinations as may be prescribed by the Board shall be included in the register of career executive eligibles and upon appointment to an appropriate class in the Career Executive Service, become an active member of the Service;"

WHEREAS, a CESO refers to one who is conferred the Career Executive Service (CES) Eligibility by the CESB, appointed to a CES position, and likewise appointed to a CES rank by the President upon recommendation by the Board;

WHEREAS, the CESB through Resolution No. 554 dated June 15, 2004 adopted "The Rules and Procedures Governing the Deactivation and Reactivation of Career Executive Service (CES) Ranks," instituting the principle that "once a CESO, always a CESO", Hence, once, appointed to CES Rank, a CESO maybe active or inactive depending °n whether he/she is appointed to a CES position;

WHEREAS, a CESO whose CES rank has been inactive may request for the reactivation of his/her rank in the CES upon re-entry in a CES position in the government.

WHEREAS, the CES, in its February 21, 2008 meeting, decided to revise Resolution No. 554, s. 2004 to allow the reactivation of CES ranks immediately upon reentry of CESO in a CES position in the government service without need of waiting forsl months.

NOW, THEREFORE, foregoing premises considered, the Board RESOLVES, & is hereby RESOLVED, to adopt the following Revised Guidelines on Reactivation of Care Executive Service (CES) Ranks;

1. Title of the Guidelines - These guidelines shall be known and cited as "The Revised delines on Reactivation of Career Executive Service (CES) Ranks."

2. coverage - Except as otherwise provided for by law, this Resolution shall apply to all Career Executive Service Officers (CESOs) in all departments and agencies of the government covered by the CES.

3. Inactive CES Rank - The CES rank of a CESO becomes inactive upon his/her separation from the CES through any of the following modes:
a. Acceptance of a position by virtue of an appointment outside the coverage of the CES;

b. Dropping from the rolls of government officials and employees; and

c. Other modes of separation from the CES, provided that the separation from the CES resulting from dismissal from the service for cause and after due process shall result in the loss of CES rank.

The CES rank of a CESO shall not become inactive in any of the following circumstances:

a. Those who are appointed to a CES position and designated as Officer-in- Charge (OIC) or in an acting capacity to a non-CES position;

b. Those who are seconded or detailed to another position, regardless of whether it is in a CES or non-CES position in a department or agency covered by the CES;

c. Those who are placed in the CESO pool.

A CESO, whose CES rank has become inactive shall not enjoy the rights and privileges accorded to him/her by law on account of his/her CES rank.
4. Reactivation of CES Rank - The CES Rank of CESO prior to his/her separation from the CES, shall be reactivated by the CESB upon re-appointment to any CES position and after compliance with the following requirements:
a. Appointment paper after re-employment to a CES position, duly certified by a Personnel Officer/Administrative Officer;

b. Service Record, duly certified by a Personnel Officer/Administrative Officer; c Updated CES Personal Data Form (PDF); d- Clearances from the following offices:
i. Department or Agency of the official concerned;
ii. Civil Service Commission;
iii. Sandiganbayan;
iv. Presidential Anti-Graft Commission; and
v. Self-certification under oath issued by the CESO stating that he/she has no pending administrative or criminal case.
The Board shall not reactivate the CES rank of CESO who has been dismissed from the government service for cause and after due process.

RESOLVED, FURTHER, that the Office of the President be furnished a copy of this

Resolution for its information and guidance.
