[ DDB BOARD REGULATION NO. 9, S. 2007, December 11, 2007 ]
AMENDING BOARD REGULATION NO. 1, SERIES OF 2004, ENTITLED "PRESCRIBING DRUG TEST FEE FOR GOVERNMENT-OWNED AND PRIVATE DRUG TESTING LABORATORIES ACCREDITED BY THE DEPARTMENT OF HEALTH"
WHEREAS, Section 39 of Republic Act 9165, also known as the "Comprehensive Dangerous Drugs Act of 2002", mandates the Department of Health (DOH) to "license and accredit drug testing centers in each province and city in order to assure their capacity, competence, integrity and stability to conduct the laboratory examinations and tests";
WHEREAS, pursuant to the powers of the Dangerous Drugs Board (DDB) under Section 81(b) of RA9165, the Board promulgated Board Regulation No. 1, Series of 2004, setting the maximum allowable fees which drug testing laboratories (DTLs) can charge;
WHEREAS, the Integrated Drug Testing Operations Management and Information Systems (IDTOMIS), which was adopted by the DOH and approved by the DDB to gather data on the DTLs nationwide and monitor and regulate them, will be operationalized next year and its constant maintenance will be partly funded by the subscription fees paid by the DTLs,
WHEREAS, there has been no adjustment in drug testing fees since 2002 despite the increasing cost of reagents and related commodities;
WHEREFORE, be it RESOLVED, as it is hereby RESOLVED, to amend the Dangerous Drugs Board (DDB) Regulation No. 1, Series of 2004, as hereunder provided:
SECTION 1. Section 2 of DDB Regulation No. 1, Series of 2004, is hereby amended such that the provision shall now read as follows:

SECTION 1. Section 2 of DDB Regulation No. 1, Series of 2004, is hereby amended such that the provision shall now read as follows:
"Section 2. Fees per person shall be:SECTION 2. This Regulation shall take effect fifteen (15) days after its publication in two (2) newspapers of general circulation and after its registration with the Office of the National Administrative Register (ONAR), UP Law Center, Quezon City.
"1) For government-owned drug testing laboratories - not more than P250
"2) For PRIVATE owned drug testing laboratories - not more than P300
"3) Both fees shall include the cost of screening and confirmatory tests when needed"
