WORKAROUND PROCEDURES IN THE IMPLEMENTATION OF AO NO. ACL-2009-019



Pursuant to Administrative Order No. ACL-2009-019 dated 13 November 2009 Re: Revised Schedule of Penalties in the Enforcement of Regulations on the Implementation of the National Chlorofluorocarbon Phase-out Plan (NCPP) on Motor Vehicles, herewith are the procedures promulgated for implementation:

1. The NCPP on Motor Vehicles violation is existing in the current system under “Section O” of the LETAS violation table.

2. The accessory penalty of suspension in the third (3rd) offense shall be made available in the next system build of LETAS.

3. An interim procedure for the 3rd offense committed within a year from the commission of the first (1st) offense shall be effected, to wit:

a. Case type should be “Contested Case” at the Evaluator workstep.

b. The transaction has to go through Adjudication where the Hearing Officer shall check the Registration check box to suspend the registration.

c. The Hearing Officer shall enter the number of days for the one (1) year period of suspension of the motor vehicle registration.

d. After the payment of penalty, the offender will be advised by the LTO personnel to attend the seminar on the “Protection of Ozone Layer” in the nearest Environmental Management Bureau (EMB) Office, DENR.

e. The Releasing Officer shall release the impounded material upon presentation/submission by the offender of the Certificate of Attendance on the said seminar.

4. For the fourth offense, the system shall automatically set the status as “Revoked” to cancel the registration of motor vehicle.
