[ OP MEMORANDUM ORDER NO. 95, February 27, 1993 ]

DIRECTING THE CENTRAL BANK AND THE BUREAU OF CUSTOMS TO IMPLEMENT SECTION 23 (10) OF REPUBLIC ACT NO. 7607 (MAGNA CARTA OF SMALL FARMERS)



WHEREAS, Section 23 (10) of Republic Act No. 7607, otherwise known as the Magna Carta of Small Fanners, provides that "[i]mportation shall not be allowed on agricultural products that are produced locally in sufficient quantity";

WHEREAS, the Department of Agriculture has certified, after consultation with farmers' organizations, that the following agricultural products are produced locally in sufficient quantities;
  1. corn;
  2. poultry and poultry products;
  3. hogs and pork products;
  4. meat and meat products, except beef and beef products.
NOW, THEREFORE, I, FIDEL V. RAMOS, President of the Philippines, by virtue of the powers vested in me by law, hereby order the following:

1.         The Central Bank and the Bureau of Customs shall prohibit the importation of the following agricultural products;
  1. corn (and its substitutes, including wheat used for feeds);

  2. poultry and poultry products;

  3. hogs and pork products;

  4. meat and meal products, except beef and beef products.
2.         The Central Bank and the Bureau of Customs shall authorize the importation of any of the foregoing agricultural products only if there is a certification from the Department of Agriculture authorizing the importation of such quantities as may be necessary to meet an actual or anticipated shortage in the local production of such products.

3. The Department of Agriculture, Central Bank and Bureau of Customs shall draw up the mechanism to insure compliance with this Memorandum Order.

This Memorandum Order shall take effect immediately.
