[ ERC RESOLUTION NO. 01, S. 2006, January 18, 2006 ]

DISTRIBUTION SERVICES AND OPEN ACCESS RULES (DSOAR)



WHEREAS, Section 31 of Republic Act No. 9136 (The Electric Power Industry and Reform Act of 2001 or the EPIRA) and Rule 12 of its Implementing Rules and Regulations (IRR) provide for the implementation of a regime of retail competition and open access;

WHEREAS, on June 16-17, 2005 and July 14, 2005, the Commission conducted public consultations for the promulgation of a set of Distribution Services and Open Access Rules (DSOAR);

WHEREAS, the DSOAR provides for the rules, terms and conditions pertaining to Distribution Connection Assets and Services, Service to the Captive Market, Supplier of Last Resort Service to the Contestable Market and Unbundled Distribution Wheeling Service and Guidelines for Establishing Regulated Service Rates;

WHEREAS, the said DSOAR supersedes the Energy Regulatory Board’s Standard Rules and Regulations Governing the Operation of Electrical Power Services and ERB Resolution 95-21, as amended by ERB Case No. 95-368 in its Order dated April 10, 2000.

NOW THEREFORE, the Commission, after thorough and due deliberation, RESOLVED as it is hereby RESOLVES, to APPROVE and ADOPT, as it hereby APPROVES and ADOPTS, the Distribution Services and Open Access Rules attached as “ANNEX A*” and made an integral part of this Resolution.

This Resolution shall take effect immediately following its publication in a newspaper of general circulation in the country.
