[ LTFRB MEMORANDUM CIRCULAR NO. 2008-006, April 10, 2008 ]

REITERATION OF MC 89-012, RE: SIGNING OF PLEADINGS BY OPERATORS/APPLICANTS



It has been observed by this Board that there were pleadings filed that were signed, and/or verified by persons other than the applicants/operators resulting in dispositions affecting the CPC or application without the knowledge or consent of the applicants/ operators.

In view thereof, this Board hereby reiterates Memorandum Circular No. 89-012, Re: SIGNING OF PLEADINGS BY OPERATORS/APPLICANTS, important portion of which reads as follows:
" x x x no pleading can be filed and accepted by the Receiving and Assessment Section unless the same is signed and/or verified by the operator or his duly appointed attorney-in-fact/original applicant."
Anent thereto, pleadings filed by corporations and entities with juridical personality should be signed and/or verified by the duly authorized representative designated pursuant to a Board Resolution.

All issuances inconsistent herewith are hereby superseded and amended accordingly.

This Memorandum Circular shall take effect immediately.
