GUIDELINES IN THE REGISTRATION OF LOW SPEED VEHICLES



Pursuant to Batas Pambansa Bilang 43 and 74, RepublicAct4136 (Land Transportation and Traffic Code), Republic Act 8794 (MVUC Law), Administrative Order Number 3, and Administrative Order No. 91-005, the following rules and regulations for the registration of Speed Vehicles (LSV) are hereby promulgated for the observance of all concerned:

Section 1. Definition of Terms. For purposes of this issuance, the following terms hall carry the meanings hereunder provided:
  1. Low Speed Vehicles (LSV) - 4-wheeled motor vehicles (other than ATVs, trucks, buses, and those that are excluded from the term "motor vehicle" under Republic Act 4136), which use alternative fuels like electricity and whose speed maximum speed capability is not more than 40 kilometers per hour (25 miles per hour).

  2. Provincial Roads - these are roads that connect cities and municipalities without traversing national roads; roads that connect national roads to barangays through rural areas; and roads that connect to major provincial government infrastructure.

  3. Municipal and City Roads-These are roads within the poblacion; roads that connect to provincial and national roads; and roads that provide inter-barangay connections to major municipal and city infrastructure without traversing provincial roads.

  4. Barangay Roads. These roads refer to other public roads within the barangay.
Section 2. Classification of Low Speed Vehicles. Low Speed Vehicles shall carry the applicable classification (hire, for-hire, etc.) and denomination (cars, utility vehicles, sports utility vehicles, etc.) as provided for under existing laws, rules and regulations.

Section 3. Inspection. LSV are subject to roadworthiness inspection of the Motor Vehicle Inspection Station (MVIS) of the Land Transportation Office (LTO) and smoke emission testing prior to registration. LSV that are powered solely by electric motor are however exempted from smoke emission testing until such time that emission standards for electric powered vehicles are made available.

Section 4. Motor Vehicle User's Charge. The collectible motor vehicle user's charge (MVUC) for the LSV shall be the rates prescribed under R.A. 8794 for UV, SUV, or Cars depending on the classification (private, for-hire, government, etc.) and denomination (Cars, UV, SUV, etc.) where LSV status and configuration fall.

Section 5. Coverage and Restriction of Operation. The operation of LSV shall be restricted to a maximum speed of 40 kilometers per hour. They can be operated within the central business district or along municipal, city, or barangay roads only. They can only Pass the main thoroughfares, highways or national road for purposes of crossing only when the provincial or municipal/city, or barangay road is divided by a highway, main thoroughfares, or the national road, provided however that the LSV shall yield the right of way to all oncoming traffic that constitute an immediate hazard, or if the main thoroughfares, highways, or national road has been designated and posted as open for travel by LSV by ^ncerned government agencies.

Section 6. Plates and Stickers Assignment. LSV shall be issued a pair orange-colored Plates and stickers for private LSV. In case the Land Transportation Franchising and Regulatory Board (LTFRB) grants franchises to LSV, yellow plates and orange-colored stickers shall be issued.

Section 7. Registration. The Land Transportation Office shall issue its implementing ru|es and regulations within thirty (30) days from the effectivity of this Order for the system of registration of all motor vehicles that will fall under the classification of LSV and effective implementation and/or enforcement of this Order.    

Section 8. Effectivity. These guidelines shall take effect fifteen (15) days after publication in a newspaper of general circulation.
