IMPOSITION OF STIFF PENALTIES CONCERNING VARIOUS PETC VIOLATIONS



In view of numerous complaints and queries received by this Office regarding various PETC violations, you are hereby
directed to adhere to the following orders and guidelines:
1. Non-Appearance in the Conduct of Emission Test

PETC shall not operate on Saturdays, Sundays and Holidays. Consequently, all IT Providers and STRADCOM cannot upload
emission test on these days. All LTO officials and employees are directed to refuse emission test results conducted on the
aforecited days.

2. Unauthorized PETC and Invalid MVECT

Motor Vehicle Emission Center Technician (MVECT) shall not conduct emission
test to PETC without Certificate of Authorization. All LTO officials and employees are prohibited from giving permission for
MVECT to sign beyond his/her scope of authority.

3. Application for New or Renewai of Authorization

For new or renewal of Certificate of Authorization, PETC shall submit the Mayor's Permit duly paid for one (1) year and an
Income Tax Return and Financial Statement duly stamped by the BIR. Failing which, no application shall be accepted.

4. PETC with Expired or Invalid Certificate of Authorization

Automatic cancellation shall be meted out to PETC found to be operating or to have continued operation with expired or
invalid certificate of authorization

In such a situation, all IT Providers and STRADCOM shall block the acceptance of uploads while Personnel-in-Charge shall
not issue the Certificate of Emission Compliance, Likewise, PETC Secretariat shall not accept payment for new/ ( renewal of
said application unless accompanied with a Certificate of Authorization duly signed by the Assistant Secretary.

5. Fake, Altered or manipulated Web Cam Pictures Being Uploaded at the LTO-PETC Image Repository Server

Automatic cancellation of Certificate of Authorization shall be meted out to PETC and IT Provider found to be responsible for uploading fraudulent web cam pictures without security features in the respective IT Providers Client Program which only can be decrypted at said server.
The operation of Private Emission Testing Centers is only a stopgap in the implementation of Clean Air Act. Once the MVIS
becomes in place, all PETCs will stop operations. All LTO offices that will not be served by MVIS will be given a set of
equipment for emission test.

The aforecited violations are major violations pursuant to Annex 11 of DENR-DTI-DOTC JointAdministrative Order No. 1,
Series of 2007.

Consequently, the undersigned may initiate the filing of criminal cases against erring non-LTO employees as well as
administrative and/or criminal cases against LTO employees who, among other violations, are found after due hearing to be
in connivance with unscrupulous PETC operators or IT Providers in perpetrating said wrongful acts to the prejudice of the
service shall be dealt with accordingly.

PETC Regional Monitoring Committee (RMC) and Regional Monitoring Team (RMT) are hereby directed to conduct strict
monitoring of PETCs in their respective areas of responsibilities.

All orders/memoranda/circular in conflict herewith are deemed superseded.
