(NAR) VOL. 22 NO. 2, APRIL - JUNE 2011

[ MTC RESOLUTION NO. 7, S. 2010, December 15, 2010 ]

APPROVING THE MARPOL 73/78, ANNEXES I-VI CONSOLIDATED TRAINING COURSE



WHEREAS, The Maritime Training Council (MTC) recognizes the importance of the International Convention for the Prevention of Pollution of Sea by Oil and other Harmful Substances, otherwise known as MARPOL 73/78, and the minimization of the accidental discharge of such substances, including Protocol ’97 which provides for Prevention of Air Pollution from Ships;

WHEREAS, The regulations covering the various sources of ship generated pollution are contained in the six (6) annexes of MARPOL 73/78;

WHEREAS, The annexes are:
Annex I
- Prevention of Pollution by Oil
Annex II - Control of Pollution by Noxious Liquid Substances in Bulk
Annex III - Prevention of Pollution by Harmful Substances Carried by Sea in Packaged Form
Annex IV - Prevention of Pollution by Sewage from Ships
Annex V - Prevention of Pollution by Garbage from Ships
Annex VI - Prevention of Air Pollution from Ships

WHEREAS, the Professional Regulation Commission (PRC) under Memorandum Circular 09-24 requires the completion of training courses in Annex I, II, III, IV, V, and VI for the issuance and endorsement of the Certificate of Competency of Officer-in-Charge of Navigational Watch and Engineering Watch.

WHEREAS, there are only two (2) existing training courses approved by the Maritime Training Council (MTC) for the MARPOL 73/78 Annexes, which are Annexes I and II;

WHEREAS, as interim arrangement, the Maritime Training Council (MTC) issued Memorandum Circular No. 02, Series of 2010 which recognizes the in-house training conducted by maritime training centers in Annexes III, IV, V, and VI in order for candidates to comply with the Professional Regulation Commission  (PRC) Memorandum Circular No. 09-24;

WHEREAS, there is a need to develop a consolidated training course for all the six (6) Annexes in order that Filipino Seafarers could comply with the training requirements for the issuance and endorsement of certificate and competency for watchkeeping officers.

WHEREAS, The Maritime Training Council (MTC) authorized the development of a consolidated training course for the six (6) Annexes of MARPOL 73/78 thru the services of maritime experts;

WHEREAS, the consolidated training courses for Annexes I, II, III, IV, V, and VI were completed on 07 June 2010.

NOW, THEREFORE, in consideration of the above premises, resolve as it is hereby resolved that:

  1. This consolidated training course covers the requirements of the International Convention for the Prevention of Pollution from Ships, 1973 as modified by the Protocol of 1978 (MARPOL 73/78) based on the technical content provided in Annexes I to IV.

  2. The attached consolidated training courses for Annexes I, II, II, IV, V, and VI of MARPOL 73/78 are hereby approved as a single course for implementation.

  3. Within thirty (30) calendar days from the promulgation of this Resolution, all training centers offering or intending to offer the course MARPOL 73/78 shall be required to apply for accreditation of the full course (Annexes I-VI) in accordance with the approved consolidated training course.

  4. The following transitional provisions are herewith promulgated:

    1. Training Centers holding Full Accreditation of MARPOL 73/78, Annex I and Annex II, or Interim Accreditation under Memorandum Circular No. 02, Series of 2010 shall continue to conduct training until the application for Full Accreditation specified under Item No. 02 of this Resolution is approved, otherwise shall cease operation if no application is filed after thirty (30) days from promulgation;
    2. Maritime schools offering the bachelor’s programs (BSMT, BSMarE, BSMTE) which incorporate MARPOL 73/78 shall adopt the consolidated standards accordingly;
    3. Seafarers who have completed training under Annexes I and II, either in a training center or in a maritime school, shall earn full credits and shall no longer be required to undergo retraining in said Annexes if they enroll in the full course (Annexes I-VI) MARPOL 73/78; and
    4. Seafarers who have completed training under a provisionally accredited MARPOL 73/78 (Annexes I-VI) shall likewise earn full credits and shall no longer be required to undergo any retraining under MARPOL 73/78 as provided for under this Resolution.

  5. Seafarers who have completed training in accordance with the provisions of this Resolution, either in a training center or in a maritime school, shall be issued a NAC Certificate for MARPOL 73/78, Annexes I-VI.

  6. The Maritime Training Council Secretariat shall issue appropriate guidelines to fully implement this Resolution.

This Resolution shall take effect fifteen (15) days after publication in a newspaper of general circulation and submission to the U.P. Law Center.
