GUIDELINES ON THE GRANT OF MONETARY REWARD TO INFORMERS PURSUANT TO SECTION 5, RA 7832



1.0
Purpose

This Circular prescribes the guidelines governing the monetary reward to person(s) or entity(ies) in the recovery of stolen transmission line materials, apprehension of suspects and or conviction of offenders pursuant to Section 5 of RA 7832 otherwise known as Anti-Electricity Transmission Line/Materials Pilferage Act of 1994.

2.0
Scope

2.1 These guidelines shall be applicable to the following person(s) or entity(ies):

2.1.1
Who provide(s) information leading to the recovery of electrical power transmission line materials (TLM) and/or apprehension of suspect(s).
 
2.1.2
Who recover(s) and turn(s) over to National Power Corporation (NPC) such stolen materials.
 
2.1.3
Who recover(s) such materials, accompanied by apprehension of suspect(s).
 
2.1.4
Who provide(s) information leading to apprehension of person(s) in the act of violating Section 3 of RA 7832, preventing damage/losses to NPC Transmission Line Materials.

2.1.4.1 Section 3 of RA 7832 provides:

"Theft of Electric Power Transmission lines and Materials.

(a) It is hereby declared unlawful for any person to:

1. Cut, saw, slice, separate, split, severe, smelt, or remove any electric power transmission line/materials or meter from a tower, pole, any other installation or place of installation or any other place or site where it may be rightfully or lawfully stored, deposited, kept, stocked, inventoried, situated or located, without the consent of the owner, whether or not the act is done for profit or gain;

2. Take, carry away or remove or transfer, with or without the use of a motor vehicle or other means of conveyance, any electric power transmission line/material or meter from a tower, pole, any other installation or place or site where it may be rightfully or lawfully stored, deposited, kept, stocked, inventoried, situated or located, without the consent of the owner, whether or not the act is done for profit or gain;

3. Store, possess or otherwise keep in his premises, custody or control, any electric power transmission line/material or meter without the consent of the owner, whether or not the act is done for profit or gain; and

4. Load, carry, ship or move from one place to another, whether by land, air and sea, any electrical power transmission line/material, whether or not the act is done for profit or gain, without first securing a clearance/permit for the said purpose from its owner, National Power Corporation (NPC), or its regional office concerned, as the case may be."

2.2 NPC employees/officials shall not be entitled to reward under these guidelines.

2.3 The applicability of the provisions of Section 2.1 above shall start February 8, 1995 and the coverage shall be nationwide.

2.4 The term "electrical power transmission line materials (TLM)" as herein used refers to electrical power transmission steel towers, woodpoles, cable, wires, insulators, line hardwares, electrical conductors and other related items with a minimum voltage of sixty-nine kilovolts (69 KV), such as the following:

2.4.1
Steel transmission line towers made of galvanized steel angular members and plates or creosoted and/or tannelized woodpoles/concrete poles and designed to carry and support the conductors;
 
2.4.2
Aluminum conductor steel reinforced (ACSR) in excess of one hundred (100) MCM;
 
2.4.3
Overhead ground wires made of 7 strands of galvanized steel wires, 3.08 millimeters in diameter and designed to protect the electrical conductors from lightning strikes;
 
2.4.4
Insulators made of porcelain or glass shell and designed to insulate the electrical conductors from steel towers or woodpoles; and
 
2.4.5
Various transmission line hardwares and materials made of aluminum alloy or maleable steel and designed to interconnect the towers, conductors, ground wires, and insulators mentioned in subparagraphs (a), (2) (3) and (4) above for the safe and reliable operation of the transmission lines.

3.0
Reward

3.1 The amount of incentive that will be given to the informer(s) recovering/apprehending individual(s) or entity(ies) shall be as follows:

3.1.1 For those who shall report to any NPC or police authorities any act which constitute a violation of Section 3 of RA 7832;
 
P 5,000.00

 
3.1.2 For those who shall recover any electrical power transmission line materials mentioned herein, subject to the following:
 

 
a) If the recovered TLM hauled by NPC
 
P 5,000 + 10% of total scrap value of recovered TLM.

 
b. If the recovered TLM personally turned to NPC.
 
P 5,000.00 + 10% of total scrap value of recovered TLM + reasonable cost of hauling.

 
3.1.3 For those who recover and turn over to NPC Transmission Line Materials accompanied with apprehension of pilferer(s)
 
P 5,000.00 + 15% of total scrap value of recovered TLM.

 
3.1.4 For those who recover and turn over to NPC Transmission Line Materials accompanied with apprehension with and conviction of suspect.
 
P5,000.00 + 20% of total scrap value of recovered TLM.

4.0
Proof of Entitlement

The following shall be entitled to the Regional Anti-Pilferage Task Force for approval of the Regional Vice President concerned to support claims for reward. The documents shall include, but not limited to the following:

4.1
After Operation Report by the confiscating/apprehending military or law enforcement elements, in the case of recovery and/or apprehension.
 
4.2
Information Report Form, duly accomplished by the SSD if at the Head Office, or ranking security officer if in the region, in the case of information received.
 
4.3
Certification of the scrap value of the recovered TLM to be issued by the Materials Management Department (MMD).
 
4.4
Approval of the reward by the Regional Vice President concerned.

5.0
Payment

The processing and payment of rewards, which shall be chargeable against Work Order No. 2988041 or subsequent Work Orders for the purpose, under the Office of the Manager, Security Department shall be effected in the respective regions through the Regional Anti-Pilferage Task Force as approved by the Regional Vice President.

6.0
Effective

This Circular shall take effect immediately.
